2-10 Home Buyers Warranty Not Responsible Nationwide
I bought a new home from a builder (Hendrickson Construction) which had a 2-10 Home Buyers Warranty. Within a short time of purchase serious problems arose with the home. The plumbing leaking from one level to the next through walls, leaking roof, washing away of soil around the house causing attached deck and roof to move downward, driveway washing away, electrical problems and foundation issues. We contacted the builder, who refused to do anything. We then contacted 2-10. That was 4 years ago and to date nothing has been done. We were sent down the long road of arbitration. We had arbutration set up over a year ago through the company 2-10 requires (CAS-Construction Arbitration Specialist)...they a special alright. CAS sent their arbitrator (Scott Mers) out here and he was completely unprepared. It cost us $2000.00 that day to pay our professionals who were to testify. Mr. Mers stood on our porch smoking and talking to CAS office for 2 hours. The arbitration was posponed. CAS had us to redo all the paper work...which took hours for us to do the first time then by the time arbitration was to come our engineer passed away, so we had to get another engineer with a new report which took some doing. Most engineers do not want to get caught up in arbitration. CAS and the builders attorney drugg their feet on scheduling arbitration. Finally on Nov. 25, 2007 we arbitrated the case at the home location. The builder showed up with person's not on the witness list. Keep in mind that CAS made it clear to us that all mandates would be followed even though the builders attorney had contacted the arbitrator several times...which is against rules of arbitration. It would be like one party contacting the judge in a trial case. 2-10 was told of this but they did nothing nor did CAS. We went forward with arbitration even though the process was very unprofessional and the arbitrator was more worried about his next cig than the case. We have $130,000. in damages to our property. When the arbitrator finally got his verdict to us (it took 3 months not the 30 days that is required by 2-10 and CAS) we were denied everything except $1600.00 of damages...that is right. One bathroom cannot be used and one side of the home is slidding down the hillside. We have a leaking roof, toilets overflowing, etc and the builder nor 2-10 is responsible. I would recommend if anyone is buying a home and it has a 2-10 Home Buyers Warranty use the warranty book they give you for toilet paper because it will actually be of use to you that way. I do not know how this company or companies have gotten anything but bad reviews. It was a three ring circus in our case. Do not give up your Civil Right and agree to arbitration. Please, if anyone can learn anything from my experience...do not give up your Civil Rights...it is not worth it.
