They claim they shipped something via FedEx, gave me the tracking number.

FedEx says the package was delivered, but I have never received it. When I call FedEx, they say contact the shipper, because they are the customer, who has to file the claim, not me. Contacting the seller, first I get a reply from them that they want my signed statement and a police report (!), then, 10 minutes later another email (from the same person) saying the refund will not be issued, because FedEx says that the package is delivered. 

Do not deal with this company. I don't know (and never will now, I guess) if they actually shipped anything (and what exactly it was, if they did), but at $26 shipping and "handling", their responsibility does not end with dropping the package at FedEx. You pay money for having the merchandise delievered to you, and a business, that takes your money and fails to provide is a rip off.

Mr. Tkach, readers of RipoffReport are not dumb. FedEx delivered the package and left it in front of your door (see the snapshot of the Delivery Confirmation). You had plenty of time to contact FedEx and ask them to re-deliver or leave at either FedEx office or Kynko's. You did not. Why? Just, please, stop with you lame excusses. It was not our responsibility to make sure you are home. We both know why - you decided to keep the hoops, claim that FedEx never delivered (when in fact they did) hoping to get the refund from us. BTW, you never asked to re-ship you the Rhythmic Gymnastics Hoops. No, you went to straight to a refund. We are totally convinced that you are a crooks and this would not be your first time trying to take advantage of businesses. When we accasionally make a mistake we admit to it and fix the situation but your case is different.

I certainly hope so.

They can decide for themselves what possible reason would I have to lie here, and what obvious motive you have.

If they were indeed dumb, they might even believe you. Well, if they do, so be it ... they'll soon find out for themselves.

First they claimed they shipped something (which, as far we know, could be a pile of used toilet paper).

Then they said the package was deliverd (when it was not)

Then they alluded they are not responsible for delivery (which they certainly are)

Now they are saying that they have actually spoke to fedex, and were told that I "never contacted them" (yeah right!), when I have the claim number. 

They don't like crooks? Must have real hard time living with themselves, I guess :)

Well, what can I say?  I am 100% convinced that this is not a first time the Tkach duo is trying to extort the money from businesses, claiming they did not receive the goods.  As anyone could see, on our first rebuttal we have provided evidence that the shipment was safely delivered to their residence and, as instructed, was left in front of their door.  Tkaches did not make a single attempt to contact FedEx and rearrange the delivery.  Instead they demanded the money back (not the "missing hoops" but the payment).  They were educating us on filing the claim with FedEx.  We refused.  We spoke with FedEx and they confirmed the delivery.  FedEx is our partner and we are not to file a fraudulent claim just to make Tkaches to benefit from their heinous acts.  Perhaps Tkaches had better luck with other purchases previously but in this case they have miscalculated - we do not like crooks and we will not kneel to their demands.

The "rebuttal" to my review obviously just reinforces my point: would you want to buy from a business, whose policy states they are not responsible for providing services they charge you for? 

I'll let you decide for yourself.

  • On December 15, 2014 Action Rhythmics customers were properly notified, on the first page of www.actionrhythmics.com, that “Action Rhythmics will be closed for Holidays from 12/20/2014 through 01/04/2015. All orders received during this time period will be mailed after 01/05/2015.” • Ms. Tkach order was processed, as promised, on 01/06/2015, picked up by FedEx on 01/07/2015, and delivered on 01/08/2015, at 10:28 am. (Support: FedEx delivery confirmation, Tracking Number: 772487970274, fedex.com). • Action Rhythmics clearly states in its “Shipping” Policy: o Action Rhythmics is not responsible for items lost in route to your delivery address. If you disagree with this possibly – do not order from us. o A tracking number will automatically be emailed to the email address you entered at the time of a purchase. o Domestic buyers – Action Rhythmics will automatically email you a tracking number. • Ms. Tkach selected FedEx Ground as her shipping method, not one of FedEx overnight services. To ship a box of this size overnight would probably cost over $200. FedEx Ground estimated 1 Business Day delivery and in fact it was delivered in one day after it was shipped.

 As far as Ms. Tkach’s claims that she was overcharged – well she ordered two oversized items that cannot be shipped via USPS. The only choice is FedEx. The customer was properly notified of this fact before placing an order. The size of the shipping box is 43” X 35” X 3”. Just out of curiosity go on fedex.com , enter these measurements, enter the from and to cities (New York to Boston), and check the prices. You will note that customer received a hefty discount, thus her claims of being overcharged are absolutely baseless.

It is your responsibility to monitor the progress of your shipment. In most cases USPS, UPS, and FedEx will leave the shipment at your door UNLESS you tell them not to. In most cases a simple note on the door “Not to Leave the Package” will work fine. Private delivery services such as UPS and FedEx provide you a number of options how you can receive your package: UPS, FedEx centers, local Kinko centers, etc. • An automatic email with the tracking number was emailed to Ms. Tkach on 01/06/2015 at 20:52:15 with both tracking number to the email address she provided at the time of placing an order ([email protected]). Moreover, curtesy emails were sent to Ms. Tkach by FedEx, informing her of when the package was: o Shipped o Tendered o Picked up o Exception (if any) o Delivered • By placing an order with Action Rhythmics Ms. Tkach agreed to the terms and various policies of Action Rhythmics.

Ms. Tkach was notified a number of times that if she did not agree with Action Rhythmics “Shipping Policy” she should place an order. • Moreover, Ms. Tkach was notified by both Action Rhythmics and FedEx on the status of her shipment and had a number of options at her disposal to receive the package (re-delivery by FedEx when someone is home, local Kinkos, local FedEx center). • As far as Ms. Tkach’s claims that she was overcharged – well she ordered two oversized items that cannot be shipped via USPS. They have also claimed this would be a "1-day" delivery, when they charged me $26 for it. However, according to FedEx, the package has not been shipped until 01/06 (I bought it on 01/02), and "delivered" on 01/08 - a week from the day of purchase. Of course, the fact that it was never delivered at all makes this point almost moot, but still ... to recap: they charge for 1-day delivery, don't ship for four days, then ship with the second-day service, lose the package, and refuse to refund the money.
