They paid me via Paypal and gave it to their daughter (who then took it to Mexico). The buyer confirmed ordering (and reciept) of the phone in e-mail, then a month later expressed remorse and wanted a refund. I agreed to provide a pro-rated refund based on the usage at the time the phone was sent back. Buyer filed a claim with Paypal and I explained (within 24 hours of getting the request for information) what had happened - including providing the tracking number of the completed shipment. 3 days later I get a e-mail from Paypal reversing the entire transaction - GIVING THE BUYER ALL OF THE MONEY BACK - while the BUYER GETS TO KEEP THE PHONE!! Starting jan 2008 money has been took out of my bank account and transfered itno a paypal account.!1 I have know knowlege of paypal 2) don't know how they got my bank info or debit card which I had to cancel.3)Paypal stated that I have an ebay account,which to this day I never had.3)all packages I suposely bought was sent to my address. when I we recieved package I know who its from or I send it back!!!$936.00 was taken out of my account.when I called at first they stated it will be resloved and my money refund then said since it was sent to my address ,that I could not recieve a refund!Then they kept making up excuses! On July 18th of 2008, I made a mistake of buying a Nokia E90 off IOFFER from a seller CHOLEBLING. The seller first told me that they did not have paypal, but her sister did. So when I sent it via paypal, the paypal email my money went to was [email protected] which is odd. Her and her sister have the same address? So the seller supposely sent out the package. Within a day of sale completed, the seller then had the nerve to ask me to leave positive feedback. I told the seller no because I need to receive the phone first. I trusted this seller because they had a rating score of 189 which was from a feedback grabber. They claimed to sell on ebay, but they also had sold other items on ioffer. I then learned that the other buyers have heard nothing and did not receive anything from this buyer. Ioffer then sent me a question form if I have received the item. This was day 8. I simply put in no because I havent yet received it. The seller got furious and basically cursed me out for doing that. I was being honest with ioffer. I started to have a gut feeling that something was up. July 29 I received a brown package with just my name on it. I then noticed there was no return address. I had to sign inorder to get it, so stupid me signed it. Being excited I opened it up to find a old, broken NOKIA 9500, NOT A NOKIA E90! I was furious! I jumped on ioffer and wrote fastly to the seller demanding money back due to 'NOT AS DESCRIBED.' The seller had that in the listing. She refused saying that I was lying. I even have links on there in the conversations that takes you to photobucket where I took pictures of the phone they sent. IT shows that it is NOT the phone I have ordered! This person just cancelled their ioffer profile on August 15 2008. So I then contacted PAYPAL to get my money back on July 29th. I filed a 'BUYER COMPLAINT FORM.' Paypal then closed it within 5 min when I filed it! WHAT?!!! They said because I didnt purchase off EBAY they closed it! In PAYPAL policy states otherwise. So I uploaded evidence and faxed 40 pages plus to PAYPAL. NOTE: FOR SOME ODD REASON YOU CANT UPLOAD PICTURES TO PAYPAL, WHAT A CROCK OF ****! Paypal then used it as a claim because I had evidence. Three days passed and I have contacted PAYPAL everyday for about 4-8 times a day about this matter getting the runaround and different answers each time, the seller then contacted PAYPAL telling them it was the phone they sent. BUT I SENT THEM PICTURES TO PROVE OTHERWISE! WHAT IS PAYPAL BLIND?! So PAYPAL found in favor of the seller. Of course! Because they are scammers too! So I appealed their decision. Everyday I called PAYPAL numerous times, being transferred to different departments, and getting different excuses and answers. I noticed that I was getting no where! So one of the PAYPAL rep. told me that I can do a chargeback. The other rep said I can try to return it, but I informed them there was no RETURN ADDRESS and the seller never would give me an address. I simply asked a PAYPAL rep for a return address, they couldn't give it out, but that rep did noticed that their address wasn't even a address! WHAT?!!! THEY ARE ON PAYPAL AND DONT EVEN HAVE A ADDRESS LISTED?! WHAT KIND OF BUSINESS IS PAYPAL OFFERING HERE? YEAH SCAM! So I then contacted my bank for a chargeback due to 'NOT AS DESCRIBED' purchase and gave them every evidence possible. They then knew it was a fraud situation and they did get my money back to my account. I then noticed that froze my account and I had a negative $409.99 in my PAYPAL account. I called them after they tried to get it back from me but my bank refused, and they said that since I did it through my bank, which is same as chargeback, that the seller didnt have the funds in their account so they took it out of PAYPAL, so I then owe PAYPAL $409.99. Yeah right! My bank found in favor of my side because they actually looked at every detail from the fraud from ioffer and PAYPAL and they knew too it was a fraud and scam situation. I do not owe PAYPAL anything! In fact one of the rep from PAYPAL told me that my $409.99 never came out of my account on July 18. They said exact words; ' When you tried to transfer funds from your account to the seller, it never went through that your bank stopped the funds from going to them.' So if this were true, PAYPAL DIDNT LOSE MONEY! But I assure you in my transactions that it did go through and the scam artist from ioffer did get their money! My bank returned it to me. Thats my money, not PAYPAL'S! PAYPAL claimed that they did not cover 'NOT AS DESCRIBED' items outside EBAY. So when my bank got my money back during the chargeback, PAYPAL claims I stole their money?! PAYPAL actually helps scammers! They dont care about your money! Now that I got my money back, PAYPAL wont let me use my PAYPAL because of that. ITS NOT FAIR! I AM THE VICTIM NOT PAYPAL! NOT THE SELLER! SO WHEY ARE THEY DOING THIS TO ME?! WARNING TO ALL: If you are thinking about purchasing anything from anywhere outside of EBAY, remember this, always look at the SELLERS feedback and if you do get it and you have to sign it, before you sign, open the package to make sure it is what you ordered! Also ask for a return address, a real one in fact. So if anyone can help me on this please help me.
