NEW PRAGUE,#2UPDATE EX-employee responds

I worked for Alliance One before it was Alliance One.. it was Triadvantage. I worked for the company for a few years because the money is really good! They tell you to practice illegal collections, basically harrassment. Then when there is a head honcho on site or listening to the calls.. then we have to make sure we follow the laws to a T (how it should be all the time) If you ever have a complaint about a collections rep, and ask to speak to the supervisor.... Dont even bother, they will either yell at you and tell you that you are in the wrong or they will agree with you and say they will do something and wont do anything but laugh when they hang up the call... If that person is even really a supervisor. They are told to set up as many payments in advance as possible to get long term payments set up and if there is an issue where you need to change it or anything... too bad! These collection reps make lots of money, every time you make your monthly payment, they are making money off of you. So, if you are on a payment arrangement and you pay a small amount each month you will probably still get called from them (they cannot do) demanding more .. so they can hit their monthly goal and make more money!! Remember anything and everything you say to them, they document and will twist around and try to abuse you with the information. It is crazy! Also, some of the people working for the company.. you probably dont want (no matter how bad your credit is) to know your information. They will treat you lower than low.. but in reality most of the people working there have the same issues if not more If you play games with them on the phone... remember they love that and will harrass you

I used to be a bill collector, so I do know the law. First, they are not allowed to contact your employment if you just say "don't call me at work anymore, I can get into trouble." If they do it again, file a complaint. This is a direct violation of the FDCPA federal laws to protect consumers such as yourself. Second, most third party collection companies CAN NOT file suit against you. They can recommend to the original creditor that this bill be set for litigation but they can't file themselves. Third, if they did state this to you, again, this is in violation of the FDCPA laws, file a complaint. Get the time, date, who you talked to etc when you file this complaint. Also, if you send in something each month...consistantly, and that is the important word, consistantly, if it does go to court, chances are it will be thrown out because you have now set up a payment history. It might not be what the collector wants, but it is something. I had a little lady pay me just 15 a month on a bill for 3 years. That is all she could afford. I kept it out of court and the original creditor knew that if they did try to sue that little lady, the judge would throw it out. Finally, whatever you owe, do not go to one of those debt counseling places. They charge you. A percentage of what you pay them comes out first, then the rest of what you pay them gets divied up among your creditors. The collection agency does not have to work with the counseling place and the original creditor could possibly still set an account for litigation. Also, you account still looks bad on your credit report. It is always best to deal with the original creditor themselves. Even if your account is in collections, call the original creditor. Nine times out of ten, they might pull it back and work with you. Especially in today's economy. I hope that helped. Make sure you call them and tell them to quit calling at work first and foremost! Good luck to you!
