Avior LLC, based out of Peppers Pike OH (near Cleveland) was one of many sellers at a liquidation sale going on near my home.  I saw that they were selling about 5 or 6 laptop computers and decided to check them out.  The only salesperson approached me and began to tell me about one computer in particular, a Gateway Laptop, model MD2614U.

After him introducing me to this computer, he began to tell me the basics, that it had a 2 GB hard drive, Microsoft Office package, it had never been used and was only about 3 months old.  He was a persuasive salesperson, telling me how he recommends this laptop "as a friend and not just as a salesperson."  He then say that I was interested, but worried it didn't have that much to offer for the price, so he began to tell me that instead of selling me this model laptop with a 2 GB hard drive, that he would add an extra 1 GB, instantly to the laptop I choose.  Also, he said that he would include a battery that would outlast the generic battery given to any customer when purchasing a laptop.  All of these things would be included, in addition to programs like Nero, and other security programs, for only $60 extra.

The starting price listed for this laptop was $1100.  But, since it was the last day of this liquidation sale, he offered to cut it down to $599 plus the $50 charged for the additions.  I was pleased with this price and told him I'd buy it.  He ran my credit card through their machine, and was approved, like usual.  I was then invited to sit down the another operator of this business to show me what the computer looked like.  Everything looked fine, and just like the display I saw throughout the sellers presentation.

That's when things got suspicious.  He handed me my receipt to sign, approving the charges.  That's when I noticed that my bill was for $730 instead of the $680 or so I had added it up to be.  Well the sells person neglected to tell me that there would be a 3% charge for purchasing with a credit card in addition to the 7% tax.  That's when he put everything into the box and taped it up.

Unfortunately, I get home and open the box, to find only the Gateway Laptop, it's power cord, and a plain looking rewritable cd that was not labeled.  There was no instructions, no sofware CDs, no information about warranties, nothing!  I then got really worried and began to browse online only to find the worst:

All of the extra materials I paid at least $50 for were all standard in this laptop.  He did not "add" and extra 1 GB to the computer in addition to an extra powerful battery, they came with the computer, straight of the factory.  Also, the laptop was not just 3 months old, it had been released on January 15, 2009 and was almost 8 months old.  Because it was not as new as he said, after calling Gateway, I find out that the warranty had already expired!  And to think they told me that if I had any problems to send it to Gateway or even their shop and they would replace it because it's under warranty!  Also, it only offered Microsoft Office 60-day trial, not the whole office package.  To make matters worse, Gateway's standard price for this model laptop was $550, not the $1100 advertised from this company, Avior LLC.

But, considering all of the fallacies mentioned above, perhaps the worst was the fact that the rewritable CD included with the laptop, was copyright unlawfully and was sold to me.  All they did was take a name brand, copyrighted program (from CDs sold with any computer) and made copiest to give to customers, like myself, who bought their computers.  Knowing all of this, I decided that I could not keep the computer, afterall, I didn't have any proof that someone did not own this computer before me, and didn't want to risk it.

So, the very next day, I told them I wanted to return the laptop and confronted them with all the lies they hold told me, and things started to get quite heated.  They told me that they have a 20% restocking fees for returns and that out of my $730 spent, they would not refund about $150.  I tried bargaining with them, saying that I would be willing to pay $30 or $50 for the return, but the sales person told me that it is not his call, and that he would have to talk to him manager, who is not in for three more days.  I then asked him, what would be an okay price for the returning and he then offered for us to pay himi $100 for the return, despite him saying previously that it was not his call.  I realized I wasn't getting anywhere and was lucky enough to talk to the manager in charge of the whole Liquidation sale.  He then talked to his manager, and I was then refuned the full $730 in cash.


My intention is not to blast this company and drive people away from even considering them.  I hope that next time, customers (including myself) should be more wary and informed about considering to make such a big purchase, like a laptop.

I do thank the manager I talked to at this event for being so understanding and taking the time to hear me out and speaking rationally with me, even though I probably seemed a bit frazzled at that point.
