The bottom line, and I don't mean to sound harsh - Balance your checkbook. When you signed your signature card with BoA, you took on a certain responsibility. When you don't keep up with your transactions, it not the fault of the bank but your own. The rules work the same at all banks. If you don't have the money, don't write a check or use your checkcard. Knowledge is power, so let me impart some upon you. Take the 2 seconds it takes to write down your transactions right after you swipe your checkcard or write a check. When you use your checkcard, the money doesn't then magically go to the merchant. They have simply authorized the amount (much like verifying funds when a check is presented). The funds are held or suspended for a period of time due to the authorization which is usually 24 hours for most. The money is then collected at another time.
