On September 13, 2009, I was looking for a truck on Google, and it brought me to Craigs list, which stated that a truck was for sale.

At 2820 N I st Ave. B&B Performance, The ad stated something like 1980 Chevy for sale, Rebuilt engine and transmission, just painted, some parts not installed but for a small price will finish. I went down to see the truck, looked nice, but needed to be put back together, the mechanic took me to a brown and white suburban and told me he was going to take the air conditioning, tilt steering wheel, door panels, radio, and seat belts and put them in the truck. He stated it will be a nice truck when it is done. I asked him how much for the extras.

First he said $600.00 then as we talked he raised it to $1000.00 which was 0k, I went into the office. Daniel W Beaver wrote out the deposit slip and the mechanic handed me a work order to sign to do the work on the truck. Or so He said he would fill out the work order later. Not understanding I was signing away my deposit I signed it and asked him to put down what he was going to do, he said he would and then he would give me a copy, He never gave me a copy. I gave them $1000.00 deposit for the truck. They started it would the following Monday and it would be done the following Friday. I went back that Friday, and it had not been worked on. They said he had to get caught up with some work, and now they would have time to work on my truck. They told me to come back in three days it would not take long for my truck, which was on or about Monday Sept 23, I did. They then said received some other work in they had to do they didnt have a change to work on the truck but would have his helper get it ready. Asked me again to come back in about three days which was Sept. 26th, again, I came back to find they got some work was done. But not the work we agreed on. the tilted steering wheel that was supposed to be added was not changed. but they fixed the old one that was already in the truck. At this point, I didnt say anything because I really needed the truck I felt just let it go maybe it will get done sooner, but no when I came back again I was told it is a easy fix it will go together fast come back again in three days, which was on or about Sept 29th.

When I came back the truck had not changed. The dash or air conditioner had not be fixed wires under the hood still hanging, and I still needed to take it to the emotions so they can put the smog parts on, again he said it is a quick fix come back tonight. Sept 30th. I came back they still did not have it ready, I steel was trying to be understanding, finally on or about Oct 17th the mechanic told me Beaver had his truck torched and tires, slashed I really didnt know why he was telling me this, but based on this and the amount of time this was taking On Oct 19th I decided to asked for a refund and I get My Money Back from Beaver if he could not finish the truck. Just to have more night mares, When I asked him for my deposit he told me l had bought the truck. I reminded him it was not a purchase it was a deposit, contended on the work being competed on the truck he told me he did not have my deposit of $1000. I then said I guess well have to go to court

On Oct 23, 09,! I drove by B&B and saw my truck was up of sale again. I called and talked the mechanic and he said it was up for sale because I didnt want it. I informed him that I didnt want it If it was not finished being repaired that I wanted it fixed as we agreed, so now I am writing to County Attorney Generals office see if there is a action I can take, The reason for going to the, County Attorney Generals office is that I cant afford the cost of a court now, Oct 24-09 8:30pm I received 3 calls, 1 after another telling me to un post the review I posted about how I had been treated as a customer. I told them I would if they would give me back my 1000 dollars I trusted them with I told them this is not fun for me, and I was not going to let them just take advantage of me like this, I just wanted my deposit back or my truck and I would take the review down, after them calling me a bunch of up seen names they then told me if I didnt take the review down that I would be sorry and now they are not going to give me my money back they hang up the phone, a few minutes later someone called that said that his dad had to go to the hospital because of talking to me, and if he dies he is coming after me, so I called the police to report it, I waiting for them as I write thisOct 24th 10:45 I was called by officer Mechtel bag #35798 with a report case #0910240778 for the threats case,

11/03/2009	Receive Business Response	Contact Name and Title: Lee Busiek Owner Contact Phone: 520-624-0709 My name is Lee Busiek, my wife and I are owners of B&B Performance LLC. Danny Beaver is a customer. I had his truck here for repair. He in turn decided not to continue repair and to sell the vehicle. Mr. Carpino was interested and gave a deposit to Mr. Beaver. Mr. Carpino dealt with him and him only on the sale/purchase of the vehicle. Mr. Carpino asked the repairs be completed on the truck. I stated that I did not really have time that I was backed up. We talked for a bit, I told him that I would sell him the parts for the vehicle for a price of $600. Mr. Carpino then stated that he wanted them installed. I told him at this time it would be at least two or three weeks before I could start working on it; and approximately two or three weeks before completion. He did not say a whole lot but eventually decided that would be ok. I stated again that I did not want to take this job that I would prefer thet he buy the vehicle from Mr. Beaver and the parts from me and install them himself. Eventually Mr. Carpino and I agreed that I would do the work for him but I never said I would have it completed one week later. He did not return to my shop for two weeks. He stated he needed the truck ASAP. I again stated that I did not have time yet and would need more time. I NEVER received or asked for any money from Mr. Carpino. AGAIN, MR. BEAVER HAS NO AFFILIATION WITH B&B PERFORMANCE. I HAD NO INVOLVEMENT WITH THIS SALE, OR ANY EXCHANGES OF MONEY BETWEEN MR. CARPINO AND MR. BEAVER. I have contacted an attorney to ensure that any damage done to the B&B Perforemance LLC name WILL be corrected by whatever meanse or actions necessary. Mr. Carpino was never treated poorly by anyone associated with B&B Performance LLC. In summation: Mr. Beaver would be the responsible party. Thus the person Mr. Carpino should be looking for and the person responsible for returning his deposit. Thank you; Lee and Lori Busiek

What they responded with is a complete lie Danny works as a sales man for this company or so he told me at time of sale and I have a pitcher of him back in 4-29-09 with his B&B shirt on and this truck was advertized and sold on B&Bs lot buy both Danny and the mechanic there are two disks in the office and one sat at each one as they worked me for this deposit money and why I had them put on the receipt will pay balance when work is compete, even in the ad for the truck at time of sale it said that truck was not compete but could be for a little more money and I told them if they could not compete the truck it was of no use to me I needed it to deliver some beds for people, there was no problem with this at time of deposit, but they were dragging their feet till I wanted the deposit back then not only did they put it together but they put it back up for sale in crags list not for the $1800 as the first time but for $3500 they advertize a lot of things on crags list and on Tucson freeads.com I am sure this is not the first time they have done this kind of this but I be leave it is the time anyone has complained, and only because of their techniques and them threatening people when they try to get their money back as they have me report case #0910240778 for the threats case I still have one of the messages on my phone calling from the B&Bs shop. Danny told me they buy and sale cars and trucks all the time, I dont know how many times they have gotten away with this so far but I hope this is the time it stops they as in B&B have wronged me and they know it I just cant believe Tucson lets them stay in business All I wanted is the deposit I gave them back and or some help getting it back and or them to be put on record so they dont do this to someone else.

office in Jan 93. On 6/7/02 I was hit by a drunk driver on I-10 by Red rock
