Capital Management Services try to collect over 10yrs old credit card paid by bankrupcy trustee Buffalo, New York
About a 10 days ago got a call from Capital Management Services regarding a credit card debt over 10 years old.The sum was for just over $1500.At that time i had filed for bankrupcy,and all my creditors were paid by the trustee designated by the court.I told them so but seemed not to matter.They called again.By the third call I found the letter sent to me by the trustee in charge and with the list of all the creditors to be paid.I asked the lady to give me the address so I can send a copy.By the way I lost my 401k., which was not at the time protected from bankrupcy so I know creditors were paid in full.I mailed that copy on the 20th.Jan.,2010.Have not heard from them since.I also went to my bank ,it still is the same bank,and the branch manager called credit dept.,and the response I got was that I do not owe and that they cant collect.They sure are trying.

It doesn't matter...debt that's 10 years old is time barred even without the Chapter 7 filing...These people are powerless over you...tell them to get lost. Per the Fair Debt Collection Practices Act, you can send them a "cease communications" letter and that will be all that you need to do. Per this law they must cease collection activity.
Send the collection agency a letter via Certified Mail + Return Receipt (NOT regular mail) stating:
Per the Fair Debt Collection Practices Act, cease all communications with me about this alleged debt. This letter has been mailed via Certified Mail with Return Receipt. Receipt of this letter is being officially time stamped.
