We also had credit cards with capital one. My bill is due on the 10 of each month and we paid it on the 10 by phone. On the 12 I received a letter that they received the payment, the amount and the current balance on the account. On the 15 of the same month they charged me a late fee and over the limit fee and reported me as being 30 past due. I had not even passed the grace period time when they filed it. I called and paid off the card and asked it to be closed. It is still opened. We received a bill for the annual fee and the late fee. Bull S@#%. No wonder they lost stock everyone is closing their accounts. It was the best move we ever made. If you get the law suit going and need my info contact me via rebuttal to this report. (Rip-off Report will coordinate this.) I will be happy to send you anything that maybe needed.

Here is some free advice in your fight against Cap One. First, they will try to have you arbitrate your claims based on an alleged contract modification effective 1/31/02. That alleged modification may not hold up in court. Moreover, if you closed your 8 months ago, you would not be subject to the modification even if enforceable. Second, Capital One's Customer Agreement appears tilted in your favor. Check out the provision relating to "Closing Your Account." Although you appear not to have closed it in writing, they appear to have acquiesced in your closing. Check your billing statements for an acknowledgement that your account will be closed when your balance equals zero. It is disturbing that a school teacher must deal with Cap One's crap. You may be happy to know that its stock dropped 39.76% in one day last week. Moreover, the regulatory agencies are making their tactics harder to get away with, and will even effect the way they report their "earnings."
