I signed up for a cingualr wireless phone in March 2004, after 6 days of service I decided I was unhappy with the plan I had purchased. In my service contract it stated that I was able to return my phone and cancel my service within 14 days without having to pay any extra fees except for the air time I used. I returned the phone and filled out the necessary paper work at Wal-Mart where I had originally purchased it.

Three months went by, and on June 20, I recieved a bill for $260.00. This was the first and only type of contact I received from Cingular. Three days later at work I received a call from a collection agency stating that I owed Cingular $306.00. I went directly to Walmart and spoke to the manager of the electronics department. He had all of my paper work and verified all of my information. He called Cingular and spoke to several diffrent people in several departments, they claimed I was still using the phone. He spent an HOUR on the phone with them.

Finally they agreed it was their mistake and I would only be responsible for $41.00 of used air time. They also assured him that the collection agencey would be notified and I would no longer be contacted by them. They said that I would recieve a bill in the mail in two weeks.

A week went by and I got another call from the collection agency. They still claimed I owed them $306. I called Cingular immediatley. I talked to a very nice guy (can't remember his name) who told me my account had been credited and I only owed $41.00. I told him I was concerned about my credit being damaged so he refered me to Connie in collections.

She was very rude. She told me it was my fault and the reason I did not receive my bill was because my apartment number was not on my service contract. I pointed out that I had a copy in my hand and my apt. Number was in fact on there. She then proceeded to tell me I could give her my credit card number and pay the bill, but she was going to have to add %18 because it went to collections.

I refused, and insisted she send me a bill. She said I would have to speak to a manager. I was told that Geramy Asher would contact me in 24 hours. He never did.

Four days later I received another call from the collection agency saying that they recieved my payment of $260. I told them I didn't make a payment, cingular did because it was their mistake. I was told I still owed them $84. I told them I was in dispute with Cingular and (they were very nice!) they told me to keep them posted as to what was going on.

I called Cingular again and talked to a manager named Ben. He was very rude and told me it was my fault it went to collections. WHen I asked him if I could speak to someone else higher than him he told me no because they would tell me the same thing. He also said they called me three times and left messages. I never received any contact from them, at any time.

Every time I spoke with a rep at Cingular I told them I would be happy to for the air time I used. I am still struggling with them. Do you know how embaressing it is to have a collection company call you at work?

All I want is my credit history cleared.
