I have had cingular service for over 4 years. About 13 months ago, me and my wife signed up for a family plan. It was supposed to be $40 for primary line, $20 each additional line. So about $60 dollars a month.

We have an auto bill pay and they do not send us detailed statements, although I have asked. Every month our bill was around $90-$100 dollars. I never really thought much of it, just figured roaming, out of area, fees, etc. I finally decided to up the minutes because I figured we were going over. So after two months of calling asking for a detailed bill (so that I could see how many minutes we were actually using) they would never send me a bill.

Finally I went down to a cingular store and asked a manager to print me out a detailed bill. They did and something caught my eye. I had over 3000 minutes sitting in rollover. So I went over the bill with the manager and found out that we had two phones, on the same bill, one was on the $40 family plan and the other was on a regular $40 plan.

They have been overcharging me $20 a month for 13 months. I called cust. serv. and they admitted it was there mistake but said they would only credit me $60. After getting the run around, I was told lie after lie. They said when I pay the bill that I am agreeing everything is correct. I asked where that was stated in writing and they said on the bill. It says no such thing.

I filed a complaint with the FCC and got a call back from cingulars "office of the president" saying they would give me $60 and that is it. I refused. I am now talking to my attorney and if it is not resolved in 30 days we are filing charges.

The thing that is saving me is Best Buy. The best thing about that place in the teenagers selling the phones. I never signed a contract for cingular. I just paid for the phone, they activated it, and that was it. They gave me a copy of the contract and they were supposed to fill it out and have me sign it, but they didnt. So my attorney said that because of this cingular has nothing in writing that I agreed to.

The saddest part of this is their priorities. I have been a loyal customer for over 4 years and would have been for many more. But they would rather steal my $260 (which is 3-4 months of bills) and let me cancel my service. If they would have given me credit I was owed, I would have kept my service for many more years to come.
