on 11/10/04 I purchased a samsung HCN529W 52inch rear projection TV. I purchased this at the Poughkeepsie, NY store. First off the tv was an open box, floor model, so I got it for 300 off list. I was excited. This is where the happy days end.

I later found out the TV was discontinued from Samsung because of repair problems. I was never told this during the sale, the salesman just kept saying what a great deal it was. Within 30 days of getting the tv in my house, the tv broke. Called circuit city for repair, said no problem someone would be there to fix later that week. A service rep from Stanton TV in Danbury CT, came and said it would be easier to fix if they brought it back to their shop, so I said no problem. (I just want to say that Stanton TV in Danbury had nothing to do with my problem, whenever I called them they were helpful and nice).

Anyway week one and two was the "the part is on backorder." Week three and four I spent going back and forth with Circuit City, Stanton TV, and Samsung. Long story short the part isn't available, Circuit City sold me a discontinued Television. City Circuit is willing to give me an exchange, which I DO NOT WANT. I want my money back, but they refuse to give it to me, stating it is passed the 30 days of purchase.

I could not bring back the TV to circuit city, as i didn't have it in my possession, because it was at an authorized circuit city repair center, I thought getting fixed. How the hell can they say it is my fault that i didn't bring back the TV which i didn't have in my possesion!!! please help i am losing my mind as circuit city is hands down the worst store EVER, and after this is over i will NEVER spend another cent in their horrible stores. How this company can treat its customers like this and get away with it is amazing.

I don't believe that this is a rip off. The return policy is stated CLEARLY on the receipts. It is on posters all over the stores. 20 days, and even 14 for some particular items. When the repair shop told you that the part was on back order, you could have asked for the TV back so you could get your money back within that 30 days. You admit that you allowed over 2 weeks to pass with the part on back order. In that time you could have gotten your money back, you were not thinking of returning the TV at that time. When you found out that it was a discontinued TV you could have returned it as well. This would only be a rip off if it was within the 30 day policy and they refused to take it back, after 30 days, they are following policy. Sure, you can think the policy sucks, but its not a rip off.
