Subject: Open Box of $150/= for defective computer returned

Reference: COMPUSA built PC, Serial Number 2401022-1

Dear Larry.

I tried to buy new computer with good intentions to replace old computer. The computer was bought from COMPUSA#291, Phone [408]554-1733 located at 3561 Elcamino Real, Santa Clara, Ca 95051. It was COMPUSA brand serial number 2401022-1.and purchased on May25,2003.Once I operated computer at home in few days brand new computer would not boot up properly.I called COMPUSA service center for help.They were kind enough to assign a technician. After reinstalling Video card the computer worked fine but broke down again.The technician again came to my home but this time he could not fix, so per his advice I returned the computer on Jun3rd.2003. at that time I gave COMPUSA option that I will buy another computer from them but as the policy of COMPUSA stands that they will still charge me Open Box Fee unless it is the same brand I buy. Since COMPUSA home brand is troublesome, does not have Quality and Reliabilty data established and any data to support it like HP and IBM made, so I decided to buy brand names for which COMPUSA would not refund me Open Box Fee but only refunded cost of the computer. Having received unfavourable reply from your COMPUSA oulet, I decided take up this matter with Bank Of America through whose Credit Card I had paid for this computer. Unfortunately it took their corporate office several months to decide I should take up this case with the merchant directly. To conclude given COMPUSA are selling and packaging "Defective Products" once a while in boxes which cannot be fully tested in store for functionality,quality and reliability but such problems are time dependent and become obvious with time, I see no reason why I should pay Open Box Fee for a product that started malfunctioning in first week only. I had already chat with Store manager, also with the regional office and legal department. Both declined my request. The only course I have is to address issue to you or go to Small claims court .
