This is why web sites like RIPOFF REPORT will never work, they let anyone publish absolutely anything without the proper verification mechanism in place.

And now with respect to Mr. Roman Portnoy and his story, here are the facts:
Mr. Roman Portnoy president of AVION-MULTIPLEX CONSTRUCTION INC (as he claims) attended an Auction in Vancouver on April 10th, 2011. He bided on an Omega watch and was the winning bidder.
All watches sold by Cooper Sterling Auctions have one year LIMITED warranty wether pre-owned or new.
Shortly after Mr. Portnoy contacted Cooper Sterling Auctions having some concerns with the watch not keeping proper time, he was advised to ship the watch to Toronto for service however Mr. Portnoy for some reason believed he should be able to take the watch to whomever he so desires for Service and Cooper Sterling Auctions should pay any costs involved. Mr. Portnoy was offered a refund which he refused and insisted on having the watch serviced by a watch service place of HIS choice in VANCOUVER.
Cooper Sterling Auctions in an effort to proof its commitment to customer service agreed with Mr. Portony's demands, a quote of approximately $800.00 was provided by Rodeo Jewelers in West Vancouver (AUTHORIZED OMEGA DEALERS) and Cooper Sterling Auctions agreed to pay the charges upon completion of service with the condition that "COOPER STERLING AUCTIONS WILL NO LONGER HAVE ANY RESPONSIBILITY WITH RESPECT TO THE SAID WATCH" and it was all agreed upon by both sides.
The watch was services by RODEO JEWELERS in West Vancouver and a cheque in the amount of $800 and some change mailed to Mr. Portnoy.
Eight months later Mr. Portnoy contacted Cooper Sterling Auctions claiming the Bezel of the watch is not manufactured by Omega and as such demanding a full refund. Now without getting into the details of Mr. Portnoy's personality, he lack's manners, all together, no manners at all so, you can imagine as to how he would be talking to Cooper Sterling Auctions over the phone and, as such, even though he had taken the watch to somewhere else for service and, had it for almost one year Cooper Sterling Auctions eventually agreed to take the watch back, refund Mr. Portnoy minus the $800.00 Cooper Sterling Auctions had paid him to have the watch serviced by an "OMEGA AUTHORIZED DEALER OF HIS OWN CHOICE" which we had agreed after that the warranty offered by Cooper Sterling Auctions will no longer be valid (Mr. Portnoy agreed to this) and that Cooper Sterling Auctions will not be responsible for any other services required for this watch after that (Mr. Portnoy agreed to this as well).
Mr. Portnoy did not agree to pay back the $800, he demanded a full refund and argued he has the right to keep the $800.00 as well.
Cooper Sterling Auctions did not accept Mr. Portnoy's offer.
Mr. Portnoy took his case to Better Business Bureau which sided with Cooper Sterling Auctions.
Mr. Portnoy then started printing lies and made up stories on web sites such as this one (RIPOFF REPORT) Cooper Sterling Auctions simply had no choice but to publish its side of the story.
And finally Mr. Portnoy did the absolute unbelievable; he filed an action with the small claims court in BC, wrote the wrong address on the service envelope, naturally Cooper Sterling Auctions did not receive notice of his action, he then filed an affidavit of service which contained the correct address (he simply mailed the notice to the wrong address and lied to the court that it was sent to the correct address). He was then awarded default judgment which, he served upon Cooper Sterling Auctions to the correct address.
Cooper Sterling Auctions was forced to file a motion requesting the judgment be dismissed and case be re opened.
During the motion hearing Mr. Portnoy almost convinced the court that had done nothing wrong till he mistakenly gave the actual envelope that was spouse to have been received by Cooper Sterling Auctions to the Judge then, the judge simply asked "WHY DO YOU HAVE THIS WITH YOU IF IT WAS MAILED TO COOPER STERLING AUCTIONS" the wrong address on the envelop was also brought to Mr. Portnoy's attention. Lier was caught. Judgment dismissed, case reopened.
