I ordered a cell phone Kyocera K132 from mycricket.com on Wednesday 8/14/2007 and paid the 10 USD for the 2 Day shipping arrangement. Today is 8/20/2007 and it has been six days since I placed my order online and still I have not received my cell phone.

I called the 1-866-900-CRKT(2758) phone number and asked what was going on with my delivery, and the lady told me that it was shipped today , and that I will receive it within two days.

I then asked for a refund of the 10 USD because I did not receive the cell phone Kyocera K132 within two business days. The lady flat out refused to refund the 10 USD that I paid for a delivery within two days. If I receive the cell phone in two days time as the lady said this would bring the total of 8 days since I placed my order with Cricket Communications. Out of those 8 days, 6 days were business days and the 2 days fell on Saturday and Sunday.

I believe this is fraud committed by Cricket Communications and should be dealt with accordingly.

I'm sorry to hear this happened to you. However, let's review what you have posted: Unfortunately, Cricket cannot do much about your issue. This is due to the fact that Cricket does NOT ship the phones directly. They use another company that ships out phones that people order from their website. You stated that you ordered the phone on Wednesday, 08/14/07. However, 08/14/07 is on a Tuesday....and Wednesday is 08/15/07. Furthermore, on Cricket's website, when you are ordering, it states the following just above the box where you can opt for standard or rush shipping: "Orders placed after 12:00 Eastern Standard Time (EST) will not begin processing until the next business day. Orders placed after 12:00 Eastern Standard Time (EST) on Thursdays or on Fridays may not be processed and shipped until the following Monday. Please note: Standard shipping is free. If you would like to expedite your order, you may choose overnight or 2 day delivery; however, regardless of shipping method chosen, orders may take up to 48 hours to process prior to shipping." Based on what you've said, I imagine that you ordered your phone after 12pm EST on Wednesday, so that caused your shipping to be moved back. Basically, you were caught by the 48 hour order processing time. I'm not sure if there is much you can do about this issue.... Unfortunately, there wasn't really any fraud on Cricket's part. They did explain to you the process on their website when you were ordering.
