2009, I purchased a Samsung V9800 DVD player with a built in VHS to go on my new television. I
found this on eBay and it was advertised as a new item in an open box. Upon
receipt of the merchandise, the box was labeled as a salvage item and not resalable.
I contacted eBay about the deceptive merchandise and the Customer Service Representative
stated I would get a refund in a few days. I also conveyed my concerns about
disposing this equipment to prevent another sale of this item as a new dvd player.
No refund was ever issued and this machine never did work to any satisfaction. I
only watch a DVD on occasion and I am very disappointed in this machine since it did
not work more than 20 to 30 hours of play time. Today, I purchased a new DVD and
inserted it in the machine and the dvd player will not read the new dvd, I had
to watch the dvd in my computer. This same type of error has happened once before
and the dvd player suddenly started working again.
I
purchased this dvd player in good faith and it is disheartening to buy junk
that is represented as new merchandise, there is no question there was a Mistake
of Fact in the eBay listing posted by cdawgsurplus.
I
paid 49.44 including shipping and this is not the quality I was expecting.

It is unfortunate that a few members of the eBay community continue to
misrepresent merchandise to deceive consumers and are not compliant with UCC
regulations regarding e-commerce. I have no desire to return the consideration
due to the cost of shipping as compared to the total cost of the item. However,
this listing contains a "Mistake of Fact" and I can rescind my
agreement on that basis.
Labels on the box state: Non-Resalable - ship to product return center,
salvaged on 8/06/2008.
Please investigate this listing for compliance before I post negative feedback
for the deceptive merchandise shipped to me.
This communication is also a request to dispose of the "questionable
merchandise" unless the selling party chooses to send a reclaim tag to
recover the merchandise in question.

there is little concern at ebay... as their business model is based on for every customer lost,. five new ones register. Ebay has no $$$ interest in living up to their bogus "buyer protection" assurance.
I am still puzzled why no law firm has come forward to sue the unscrupulous b******s at ebay via a class action suit. I lost over $100 when I purchased a new watch.. arrived defective.. obviously was a factory defective return, but it took 2 months to get the seller to take it back. Thus ebay's 45 day dispute window was then closed. the seller kept the money and the broken watch, I am out of $$$ paid and shipping costs to return.
Ebay told me via phone call to customer service that they had no responsibility for the loss as the dispute period expired. I was on my own, and have a nice day elsewhere; and I never recovered my loss as the seller refuses to even respond since he knows ebay could not care less.. as a "power seller" ebay protects him as it does other scum bag sellers that psot "new" and are actually selling defective returns. they there is a selelr selling fauctes in CA.. as "new" .. the items sold are not new, they are store returns in defective condition.
May a just God d**n Ebay corporate executives for that as they will not even respond to letter mail complaints! It's perfectly obvious.. Ebay is run as deception and fraud by allowing it's sellers to routinely sell defective merchandise advertised as "new" when actually defective customer returns that they may buy at 10 cents of the dollar then sell as new; for $100+ they continue to sell with impunity thanks to Ebay's complicit activity. And, as in my experence, a seller can protract the return process to circumvent a dispute as Ebay will not accept a dispute after 45 days have lapsed.
Go figure.. why no law firm has yet come forward to file a class action against the "sons of Bushes" at Ebay. Ebay is run like a "prostitution ring" where customers are screwed for money. And not even the CA Attorney General will lift a finger to go after Ebay.. suggesting he is complicit.. allowing Ebay impunity to continue to make money the old fashioned way: Screwing customers via "pimping" for their "whores" IE sellers.
