This company is pure fraud. Investing? No - just take your money and run..

I purchased what I thought was a $10K package - but no part of it has come through.

The purchase involves an investment with the following:

(a) An account at www.betezy.com.au with an amount of $1200 which will be traded on

(b) A service of one trade per day on this $1200

(c) A laptop offered for joining before the 30th June

(Basically the remaining $8800 was the fee for using their service)

On the website, advertising various packages available, there should have also been a ACER TRAVELMATE laptop.

The service agreement clearly specifies the following:

I was purchasing the Data S Trading system for purchase price of $10000 which includes a $1200 bank for a period of 12 months. On receipt of the purchase, Data S Trading shall conduct the following conditions:

o An arrangement to be signed by both parties

o Trading to be done on behalf of the licence holder as stipulated in the service agreement

o Assistance to initially set up the account

o Customer service for a period of 12 months

o Profits are to be paid immediately into customers account as soon as trade has finished.

The account at www.betezy.com.au was set up.

What I am disputing is the following:

At no stage have I received any contract signed by both parties as per the licence agreement

At no stage have I received a tax invoice

At no stage have I received a receipt for the credit card transaction

The account at Bet Ezy never had an amount placed in it. and no trade was ever done into the account.

This means that never was I in receipt of a bank amount of $1200.

The trading that was meant to take place (one trade per day as per the licence agreement) never took place.

Amount to be deposited immediately after the trade had finished no amount was ever deposited.

The laptop that I received was not as per the website advertisement

The laptop received on Wednesday 3rd July is an out dated, obviously second hand computer with a failed battery. It does not switch on without the power supply connected and is there for unusable as a laptop, and the specs are: Hard drive 4GB, RAM 64MB, Processor Pentium II of 300MHz. The stickers on the laptop state designed for WIN98 and WIN NT.

Whats worse, is after aproximately 5 emaiols, 15 phone calls and a few SMS, the company took over a week to advise they will not refund my money.

Of course, being a company, they are bound by laws and regulations.

I have contacted the following:

ASIC (Aust Security and Investment Comission)

ACCC

Dept of Justice - QLD

Fair Trading Center NSW

NSW Dept of Commerce

Police Fraud Squad

All will be looking into this case for me.

Paul, The only way to get your money back is to apply for a charge back on your credit card. The law is that if you didnt sign the piece of paper that comes out of the credit card machine then Data S Trading will have the transaction reversed by the credit card company unless they can prove you signed the slip. I'm guessing you didnt. They are also providing a service agreement so you can state as part of your claim that you havent received the goods. Send of a letter to the credit card fraud dept as well. Once they get their merchant facility pulled on them they have charge backs coming in left right and centre the bank will freeze their bank accounts. Staff then dont get paid. everyone leaves and poor Harry gets left holding the baby and the corporate watchdogs are all over him for breaches of the corporations law as the director. Be sure to say as many times as you can the letters the word "fraud". Banks dont want to get left holding millions of dollars in charge backs for a 2$ company. Go get Em!! EB
