So many things have occurred with this company, that I don't know where to begin.
We have been reported late every single month, been threatened with foreclosure, even when we prepaid 6 months in advance, they reported every single one of these as late. Now they are stating we are 120 days late.
In 2001 they put us into foreclosure, for reasons above, to clear the default they demanded 11,998.89 which we paid in Sept. Stating it was for legal fees, corp fees, insurance etc, (which by the way they are force paying and we already have home owners).Because we did not wish then or ever to lose our home.
Now they say they have no record of this, they have no record of what we paid, and are attempting to collect well over 70,000 dollars on a mortgage that was 55,000 some years ago.
I have talked daily to customer service, and a different story comes each day.Since August 26. I have faxed so many times to all the numbers they give, only to find out that they say nothing was ever received.
We had a prepay penalty which ended a year ago, and they are saying it has not, because their records indicate different time frames than the paperwork we signed.
The property tax was reported paid, by them, but yet I am receiving late and delinquent notices from last year from our county saying they were never paid.
I am at my wits end, they are once again trying to collect well over 7,ooo dollars from us or take our home, we were ready to sign closing papers and now we may not be able to since they are reporting us as late.
It is a nightmare and I can see no way out of this. They are prohibiting us from refinancing, and demanding money we do not have to give.

Finally after months of trying, we were able to find refinancing. But the nightmare will not end. As I said before, I have sent dispute after dispute to these people, proof of all,even sending in the original fax receipt to prove a Sept.3 date. To which we STILL have not recieved a reply. The customer service reps always telling me nothing has been received. I have stated to them their own claim, that they have 60 days to complete their research. Being told well we have 20 days to respond and then 60 days to research. So if my math and mind are correct it has well been past both these limits.
Tonite, after 2 weeks of trying to get in touch with the loan person, (not sure of the title she carries) she tells me the following....
They misappropiated the money's sent in last year, putting it towards future payments. (I am questioning over 8 thousand dollars, and the future payments they made were 2,221.00) They can go back and change this, but it would put us into foreclosure and that isn't what we want now is it....
She said there is nothing she can do about the disputes, that perhaps they just aren't valid, hence the no contact. I got upset and said a few choice words and asked if this is how they deal with all disputes which in fact are valid. I told her that the financing would come about 2,900.00 short of what they want. She said well they will not accept since our home is worth a few more dollars than the payoff. If we send this amount they will just send it back. She said they could if they wanted settle but why should they when they can make more from taking the home.
Then she proceeds to tell me just to forget the financing, she will set it up so they would start accepting our regular payments again, until all the disputes I have are cleared...
What this means to me is, we say no to refinancing, (and this is our last ditch attempt since they have destroyed our credit), they get comfy and zero in for the kill. They have had since Sept 3rd to settle these disputes, what makes her think I expect it to be done now?
I told her I will take this further and she said oh well go ahead... I pray that we can all come together and stop these people. My heath is suffering greatly from the stress and anxiety. Holidays passed with no joy because I am constantly worried on their next move..If we give them the money they want, it will be like robbing Peter to pay Paul, and I have no idea where to come up with the rest. Since we are still paying for the large amount they got last year.
How can they do the things they do without any proper authorities taking notice? We are working class people, trying to raise a family in a home we have lived in for a very long time. What right do they have to lose payments and then say we are in default? btw, this has happened last year and now this year. Something has to be done. I have composed a letter and am sending it to every govt agency I can find. Hiring an attorney right now is to far beyond our means...
