I am a college student specializing in multimedia. An instructor at my school was approached by the company FAN-T, producers of AQUA-T energy drink, by way of their director of marketing, Ryan McDevitt. The company was seeking a web designer. The company is owned by a Dr.(?) Faik Nasser. (I have been told he is a doctor of chemistry, but I have no proof of that)

Ryan McDevitt asked me to design and develop a website for their energy drink (AQUA-T) which claims to be a Protein Drink, but has less than 1g of protein, and is really just a caffeine based energy drink.

Mr. McDevitt gave me the requirements for the site, and led me to believe that it would be an opening project towards a salaried IT position. I explained my price to him, and detailed the time requirements.

I completed the project, and in good faith (for aforementioned position) even abided by numerous contradictory changes and revisions (switching fonts back and forth, changing text sizes, changing all page copy to lowercase, then back to title case, reediting graphics, etc.) The site was up and running, with many more features and pages than initially agreed upon.

After the project was complete, the multiple revisions made, and hours of "marketing goal meetings" I told Ryan McDevitt that I needed some payment, even partial, to pay my bills. He asked I submit a new invoice, with total payment listed.

I sent him an invoice, with our agreed upon hourly rate and hours billed, even though the requested revisions and added features sent the project far beyond our initial agreement.

For almost 2 months, Ryan McDevitt promised me a payment "after one more change". When he had no more changes, he changed the hosting passwords, and told me he was not comfortable paying our agreed upon price, or even half of it.

The site has been functional for over 3 months, and I am locked out of all hosting accounts, I have received no payments, and Ryan McDevitt has informed me that he will neither pay me nor remove my work from the site.

I feel that Ryan McDevitt, and Faik Nasser have lied to me and stolen my work. I am currently attempting legal action, but as a college student, do not have access to the legal resources to match the FAN-T Corporation Legal Department.

If anyone ever has the "opportunity" to work for/with FAN-T, AQUA-T, Ryan McDevitt, or Dr.(?) Faik Nasser, please be careful, as they are very dishonest and deceitful.

Issue Resolved, FAN-T / AQUA-T settle dispute

Since my original posting, FAN-T has settled with me, and I have dropped any and all legal action against them. I am being paid for my work, and FAN-T has owned up to any and all obligations to me. I would, however, like to clear up a few issues concerning my original post. I was personally mistaken about the amount of protein in AQUA-T. I originally stated that it had less than 1g of protein. That is not the case. The label reads: "Protein less than 1g". AQUA-T actually contains 1.2g (120 mg) of protein, but in accordance with FDA regulations, the label must list amounts less than 2g as less than 1g. Some people were under the impression that I implied that FAN-T didn't offer to pay me anything for my work. That wasn't the case. They offered me [dollar amount ommitted], an amount under 1/5th what I originally quoted for the work I did, which, in my opinion, did not seem fair, but they absolutely did offer something. My prior doubts have been laid to rest regarding Dr. Faik Nasser's educational qualifications. I have been assured that he is, indeed, a doctor. Furthermore, I would like to apologize if any statements I made were construed as slanderous. My post presented my views on the events in question, not those of FAN-T.

#3REBUTTAL Owner of company

Please be advised that this item is currently in litigation and the slanderous report filed by Mr. Raymond --- is grossly innaccurate and unsubstantiated. The reason FAN-T is attempting to dissolve our relationship him is because of his unproffessional ethics and lackluster work. Despite having no agreement with him, we offered him market rate compensation for the amount of work he put into this design. He denied. Please feel free to contact us for clarification regarding any of the aforementioned details, particularly the misinformed information about the quality of our product and the credentials of our staff. We apologize on behalf of our company for any misquotations listed by Mr. Raymond and stand by the ethical demeanor of our organization. Sincerily, Ryan McDevitt Director of Marketing FAN-T Inc [email protected]
