My brother and I visited Frank Myers AutoMax in late May, as my fiance had totaled my car and I needed a 'new' used vehicle, hopefully under $5,000 as I'm on disability and can't afford high payments.
We then 'shopped' around at other dealers, but decided to go with Frank Myers due to their low/no down payment offer & lifetime engine warranty. The saleslady, Jessica, was very nice and did her best to get us a vehicle with the low/no down payment; however, I wound up having to put down $350 (it might've been $300) which was far more than what we both expected.
It took at least 4 hours before we drive out of there with a car - a 2013 Hyundai Elantra that I did not actually pick for myself. They told us that they wanted us in a great car, and that it had just been traded in.
They hadn't even cleaned the interior yet. My brother and I were quote hungry by this time, and he had something to do so we accepted the car even though I had my misgivings. Within a few short weeks - not even 2 weeks in fact - I noticed a jerking motion with the car.
The service center guy told me it was the transmission and that Hyundais need a transmission flush from time to time. I couldn't afford the $95 I was quoted so I took it elsewhere.
I left an unfavorable Google review which they didn't like. Then I have the same issue, the car making a jerking motion when I drive it. I requested an appointment with the service center again, but when I take the car in at their request, all they offer me is an oil change!
I left another bad review with a dealer rating site. The other day, I make another request for a service appointment. No response at all. I'm tired of the run-around I'm getting from Frank Myers; it's time to consult with a lawyer well versed in lemon laws.

Hi Carmen. My name is Tracy Myers, I'm the owner of Frank Myers Auto Maxx and I'm sorry you didn't receive the experience you expected or deserved at my dealership. I'm also sorry that I'm replying to this message so late. It hasn't showed up in the regular search because you spelled our name wrong. One of my employees stumbled across it today and sent it to me. With that being said, please allow me to address your concerns. My replies are highlighted in yellow below:

Your file is showing that you qualified for our no money down program and the money you paid was for your tax and tags and not for a down payment.

They told us that they wanted us in a great car, and that it had just been traded in. I'm sorry it took so long. We were waiting on your final approval from the finance company. And when they showed you the Hyundai, we didn't give you an opportunity to say "no"?

We would rather you be safe than sorry.

Your service history says the code that came up in your car was a transmission code and it was time for a factory recommended transmission service.

My direct number is 336-831-0646. If I don't pick up, leave me a message and I will call you back as soon as possible. Please know that your happiness is important to me and I'll work hard to get your car fixed or at least show you a way to trade out of it into something you are happy with. I look forward to speaking to you sooner than later. Thank you!

I had a 2013 Hyundai Elantra for 3 years and never had transmission issues I knew of and never heard of a transmission flush. Curious why your issue would not have been covered under their 10 year power train warranty. Was your car over 100,000 miles?
I will say the 2013 wasn't the greatest. That was also the year Hyundai lied through its teeth about the mileage. I replaced it with a 2016 Elantra that looked the same but was a much better behaved and equipped vehicle.
Never take a car a dealer just got as a trade-in. How can they or anyone know what might be wrong with it if they haven't even done anything with it yet?

Why are you making a big deal about the dirty interior when that was the way you agreed to take the car! However, with the transmission problem which is common with Hyundai, you should check for warranty coverage. One HUGE point...no mechanic who knows anything about transmissions will ever, ever, ever recommend a "flush"!!!
Doing that, recirculates the debris already in the transmission and on the filter. The ONLY way is to drain the transmission AND converter AND replace the filter! Anytime you "flush" any transmission, you shorten it's life because all that stirred up debris gets circulated, plugs up passageways, makes valves stick and generally KILLS your transmission.
Don't you or any other person reading this ever, ever, ever get a transmission flush!!!

I neglected to mention that my reason for contacting the service center this time is because the car will not start now. I contacted them Saturday morning and have yet to receive the courtesy of even an email response.
They also did clean the car the day we got it, I had to drive a loaner vehicle till it was finished but it still stank and after the polish wore off, I noticed dings & scratches I hadn't before. Oh well.

Any dissatisfaction or misgivings with the model or cleanliness of the vehicle or amount of down payment is a case of buyer’s remorse.
You didn’t claim the dealer has violated a written agreement so it’s unclear why you think an attorney can assist you. The North Carolina auto lemon law excludes used vehicles.
Your vehicle may still be covered under the 5-year/60,000 mile basic or 10-year/100,000 mile powertrain warranty. Have you contacted Hyundai?
