I retained Atty Gilbert in the middle of the month of April 2011 for 4 different charges, 2 of which were traffic related in order to initiate the stop. Right from day 1 he stated that he would file a series of different motions to get these charges dismissed. He never filed a motion until after 3 different appearances in court and then it was only 1 motion and at that point in time it was more out of desperation than anything else. It was done at the last minute after a pre-trial hearing date had already been set.

Atty Gilbert let the prosecuting atty believe that he wasn't going to file any motions so that the prosecuting atty was throwing the book at me because he wasn't going to get any resistance.

Atty Gilbert did a poor job at the Administrative Review Hearing and when that went sour he didn't challenge those findings and everything went south from that point on in his representation of my case.

Atty Gilbert has admitted to me on several occasions that this was all new for him and then volunteered that he was going to different students that he'd gone to school with, prosecuting atty's that he'd worked with before in other cases, and even police officers for advice on how to handle my case and the charges against me. (This was only after he'd received over a thousand dollars of the $2500 he was going to charge me) I gave him $500 the first day we spoke and he sounded promising but it was shortly after that, and before he'd volunteered that this was new to him, that I started to get some very uneasy feelings about this atty and his ability to represent me as well as his ability to maintain my freedom from incarceration.

Over the course of approximately the next 3 months I'd given this atty over $1300 of my money and I was collecting unemployment so money was hard to come by. In that 3 months the only thing he did was appear in court for 3 different hearings and attend the Administrative Review Hearing and then complained that I wasn't paying him, yet his website then(http://www.drivenlegal.com/) AND now new website (http://www.dgilbertlaw.com/), state that he accepts payment plans. At that point I'd let him know that he had done nothing as far as any of the motions that we'd discussed on the initial day that I sat in his office and wrote him a check for $500 and that I felt very uneasy about giving him anymore money until I saw more action out of him like he said he was going to do. It still wasn't until after two more appearances in court that he came up with a motion to suppress evidence (which is one of the many that we'd talked about on that initial day) which at this late point in the game was a last ditch effort.

I was furious with him and extremely nervous about standing next to him in court while he presented it to the judge and I told him so. I was so scared that I went and retained another atty. with a boat load more experience than this rookie atty had and that cost me a LOT of money and this new atty wasn't doing any payment plans this late in the game so I had to scramble to get the funds together.

Atty Gilbert misrepresented himself to me as he does on his websites. It wasn't until today that I noticed that he had a new website and this one actually tells when he graduated from Stetson Law - 2010, had I known that initially I would have NEVER given this atty a dime and would've found someone else to represent me. I will be writing to the FL Bar Association about this atty's tactics and behavior as well as rip-off-report - I got scammed by this atty and because Gilbert took his sweet time doing everything my freedom is now in jeopardy and my new atty has very little time, if any at all, to turn things around for me.

I am disgusted with atty Gilbert as I had to tell him several things to do in my case, which he never did, but stated to me that I "should be an atty". He now has a new website with his picture on it that my money obviously paid for because he didn't spend my money on fighting my case, representing me, or to "expose weaknesses in the prosecutor's case"(which comes right off of his new website).

Mr. Gilbert's law firm represented one of my children in a complex case. They keep us advised of every step of the case. I am very happy with his performance and outcome. His professionalism and dedication to duty resulted in a better than average outcome in my child's case. Thank you Mr. Gilbert.

I have used the Gilbert Law Firm on 4 occasions and i can honestly say i have never had more competent legal representation in my life. David Gilbert has saved me money and points on my license on six tickets over four incidents. i can assure you he is professional in every regard and i saved a ton of money with him. As for the previous complaint on here by one individual, i have heard accounts that he contacted attorney gilbert late not giving him appropriate time and he also misrepresented the charges he was faced with. There is no way he was going to get what he wanted in that case, ill leave it at that. Please read the hundereds of wonderful reviews David Gilbert gets and then judge for yourself.

Just the FACTS about THIS case and my dealings with atty Gilbert!

This Attorney apparently has a lot of time on his hands to be filing a rebuttal..., just a few comments in regards to his rebuttal.

First of all he was anything but zealous for my case and my new attorney even questioned me as to why this rookie attorney took almost 5 months to file one motion. (and if atty Gilbert wants to bring up DUI's that happened over 10 and 24 years ago in another state to support his claim that's a pretty lame excuse, ...and the most recent happened over 3 years ago with yet another poor excuse for an attorney that has since been kicked out of the firm - the other attorney in the firm just so happened to be the better of the pair.

This atty Gilbert has now inflated the hours that he apparently spent on my case. He NEVER spoke with me for 10 hours and any atty with experience wouldn't have had to spend 5 hours reviewing discovery mat'l OR 10 hours doing legal research. He NEVER negotiated with the Judge or State Atty either. Right from day 1 they had offered 6 months jail time and because this atty filed nothing until about 5 months after hiring him the state atty didn't have to do anything but throw the book at me. My new atty has already got the jail time reduced to 90 days on the first day in court (and it's gonna get better than that!) - and that was an offer by the states atty knowing I had a REAL atty with LOTS of experience, my new atty had done nothing except to file the motion for change of counsel that day in court, which was granted based on the inadequacies and misrepresentation from atty Gilbert. That alone should tell anyone looking for an atty that experience will go far in the court room and atty Gilbert has VERY little experience at anything with maybe the exception of schooling as he's recently graduated about a year ago from law school. On his original website he bragged about getting your traffic tickets dismissed, and he couldn't even handle the two that I got the night in question.

Furthermore, I'm not blaming atty Gilbert for the situation that I'm in - I got myself in this situation and I'll get myself out of it without his help. I hired him to get me out of it and he did little to nothing until it was too late and out of desperation. Basically he was setting the tracks down to railroad me right to jail for an extremely lame DUI arrest from an officer that supposedly has over 1500 DUI arrests. Maybe he's bucking to be a states atty....

This atty Gilbert told me of at least 4 to 5 different motions that he was going to file the day I retained him and not one of them EVER got filed. Supposedly he spent 8 hours typing up the one motion he did file almost 5 months to the day from when I'd retained him - very slow for someone fresh out of school that braggs about providing the "most zealous legal representation for all of his clients".

Do yourself a favor and overlook this atty Gilbert for someone else that has a lot more experience, ...unless of course your reading this in the year 2031 in which case if atty Gilbert is still practicing law he'll have almost enough experience by then, otherwise steer clear of this attorney!

I provide nothing less than the most zealous legal representation for all of my clients. For example, in this specific case (3rd DUI O/S 10, with recent DUI arrest reduced to Reckless Driving) the following work was performed:

  • 10+ Hours of Communications with Client,
  • 5+ Hours Reviewing Discovery Materials / DMV Formal Review File,
  • 10+ Hours of Legal Research for Motion to Challenge Legality of Stop and Administrative Review Motion to Invalidate Suspension,
  • Challenge license suspension at Formal Review Hearing,
  • Discussions with Arresting Officers and their Supervisor regarding recollection of events and departmental policies regarding video evidence in DUI arrests,
  • Consultation with former state attorneys for additional case perspectives,
  • Negotiations with State Attorney / Judge,
  • Several Court Appearances,
  • Filing of Motion to Suppress after negotiations were deadlocked at 6 months jail time.
Unfortunately, this individual would rather blame me for the situation that he is in rather than assume responsibility for his actions. As far as his claim that I lied or misrepresented anything, I will let you judge this man's character and hope that you see him for what he is.

I encourage anyone reading this to read my numerous positive reviews on the internet and disregard this complaint.
