I’m the general manager of the company that got screwed in this deal and I keep asking myself how we got into this mess. We’ve let go of most of our staff, not sure how much longer the company can stay afloat, it’s just a total mess. What bothers me the most is the lies and how they piled up and changed depending on the situation.
Larry Finally responded to the owner and now he’s claiming that we were subcontracted by another company instead of from Global directly. That would be believable except for the fact that we invoiced Global Directly, we signed a contract with Global, and when the check was paid from the customer, it was cut to Global HVAC. I must be missing something.
Following the money has been one lie after another, checks were allegedly in the mail on September 10th, after that it was three days later, after that it was three days later. Seems funny that after 3 months we havn’t even seen a penny. Once they were confronted by their client, they told them they had a check ready to go in the mail, signed and stamped for us. Funny, it still hasn’t shown up.
After we were told they were withholding payment due to the one job that had a wire issue, they said they were going to audit all of our work and we would be paid on completion, minus the cost of the labor of the audit. This was also told to their client who told them that any work audits had to be done from their own corporate and not from Global. When we finally contacted the “Sub” They hired to audit the work, he had never actually done any inspections on our work and he himself was out about $2000 from Global HVAC from other work performed.
They told us they had not been paid, we told them we saw the checks. They told us they havn’t been paid in full, we reconciled the invoices with the main client and indeed they have been paid on all but one minor invoice out of a total of $41,000 dollars!
We were told there were major code violations from the job they claimed to hold up payment, we spoke directly to the corporation and not only was the job paid, but there was never a code violation he just asked the wire to be secured.
They keep alluding to the fact that we did not stick to the terms of the contract, which is ironic in itself because the contract that they signed with the National Group, specifically states that they cannot subcontract work and must self-perform.
At the end of the day, we did a job that we were supposed to do. We did, and still do great work at a high quality. We were victims in an elaborate con. This is a family business, we all try to do our best to take care of the business, which takes care of us. Success and failure should be on our own shoulders and not determined by ill-will of others.
Other businesses are coming out of the woodwork that are in the same situation as us with Global HVAC now. I believe in Karma and actually feel bad for the Rolak's. Greed and desperation have led them to steal from the businesses and people that are trying to do things the right way. What comes around goes around.
