GMAC gave false and misleading statements to try to induce us to purchase a new GM product. The statements made by their GMAC representative were deceptive and fraudulent.

My husband and I were turning in a leased 2000 Chev Silverado. Our lease was not up until 5/03. GMAC sent us alot of info since 1/03 to try to persuade us to purchase another GMAC product. I talked several times with GMAC going over the lease and the roll back program which waives remaining payments on our 2000 Chev Silverado if the vehicle is turned in, as long as we purchased a new 2003 Chev or GM product.

I called a GMAC rep on 3/14/03 by the initials of RLC. I told him we are interested in buyin a 2003 Chev Trailblazer. We had our next lease payment due 3/18/03. RLC advised us to put a stop pay on the automatic check withdrawal. This would produce a 10 day grace period where we would not be subject to extra charges.

If we purchased a GM product during the 10 day grace period (prior to 3/28/03) our March payment would be waived along with the April payment. Also our security deposit would be applied to any overmileage. We purchased the 2003 Chev Trailblazer on 3/24/03, 4 days before the grace period ended. Our dealership, Kocerek Chevrolet took care the 2000 Chev lease turn in and we were advised that the finance manager faxed all the paperwork to GMAC.

We were expecting a final bill from GMAC of $1,310.80. We were over our mileage and the total on the over mileage came to $1760.80 and our security deposit of $450 was to be subtracted from the overmileage. Imagine our surprise when we got a bill for $2,307.46, $1,000 over what we initially expected.

I called GMAC to tell them of their mistake and they told me I made a mistake. That I simply misunderstood. I told them I wanted to make sure of what their rep was telling me on 3/14/03 and repeated it back to him. How else would I have known about the stop pay that HE suggested. There would have not been any reason for me to stop the payment on 3/18/03 if I thought I would not be responsible for it.

I told GMAC that his statements were deceptive and fraulent. He used inducement to try to encourage us to purchase a new GM vehicle. Since this I have spoke to 3 GMAC representatives and they are telling me that we are wrong. That the 10 day period was a grace period only. If this is the case I would have not had any reason to take the grace period. For what reason???

I requested that they check to see if our conversation was recorded since companies will do that from time to time. They are going to check into, so they say, but I doubt if they will come up with anything. They do not want to take responsiblity for the statements of their employees.

I now have a bill $1,000 more than I budgeted for and if I don't pay it I am sure GMAC will turn me over to collection which will mar my credit rating. Anyone who has had this happen knows what a nightmare that can be and it takes along time to try to fix it.

I just don't know where to go from here. These large conglomerates take advantage of the small people and I feel there is nothing we can do about it. We are at their mercy. It is just unfair. If I was told the real facts we would have not been pressured to make a decision on a vehicle and would have just waited.

You need to read your contract>>> The contract specifically states that the payment is due on the date indicated on your contract. It additionally states that no verbal agreement supersedes the terms of the original contract. Irrelavant of what you are told or agree to, unless it is in writing and signed by the leinholder/lessor AND you, it means NOTHING. A contract is a contract for a reason, so that things can not be misinterpreted. Did you read your contract? Never sign a contract, for a car or anything else, unless you have fully read and understand what you aree signing. Just a note, it states "Do not sign this contract unless you agree to the terms set forth."

I had leased a new Saturn. I had major surgery not long after I leased it and was off work for a while. I started getting into some financial trouble from unpaid sick leave. I tried to call and make arrangements to pay my bill on my car. I called and tried to explain that I was recently divorce, raising a child by myself with no support, I had just had a hysterectomy and had been off work for 6 weeks, and that I could send half but not all of the payment. I was told that "It's not GMAC's fault that your kid don't have a daddy), you still have to make your payments and make them in full." I was appalled. Then the man went on to say "You are the one that took on the responsibility of raising a kid and if you can't pay for this car we will come and get it". I ended up filing bankruptcy. I wanted to reaffirm on my car so that I could keep it. I only owed about $2000.00 on it. Well, when I called after filing the bankruptcy I was told to just continue making the payments and everything would be fine. NOT TRUE !!! A tow truck showes up to get my car after my discharge date on the bankruptcy and says that GMAC Financing is repossing my car due to bankruptcy. I asked the man to wait and called them while he was there. I was told at that time that the proper paperwork had not been received by them. They ended up getting the car, and my payments that I should have never made if they were going to take it back anyway. As if this weren't enough, I purchased a new Mini-Van because I needed transportation. (Not financed with GMAC) I go to get the tag transfered from the Saturn to the van because I had just renewed it. I was told that GMAC would have to send me a letter stating that they were in possession of the Saturn before I could transfer the tag. I called GMAC again to make the request. I was told that GMAC was not responsible for sending me anything and that if I needed a tag for a new automobile that I needed to stop whining and pay for my tag like all other hard working americans. I ended up having to pay around $300.00 for a tag that should have been mine to begin with. This company will mess you up. And apparently the employees are required to take classes on how to be the rudest people in the world. I will never finance through this company again.

What advice can I give you...its very simple, STAY AWAY FROM CAR FLEECING! See the fees you had to pay??? At the end of the CAR FLEECE, "all you do is walk away"! Isn't that their sales pitch? Sure, you will walk away, but only after you left them a ton of your hard earned money! Car Leasing is CAR FLEECING...and YOU are the one who gets sheared!!!
