IN 2001 I went chapter 7 bankruptcy. My bankruptcy was discharged in the early part of 2002. I included my smartlease on my 1999 pontiac gran am in my chapter 7 bankruptcy.

I puchased a recent copy of my transunion credit report and it lists gmac as a profit and loss charge off listing 7/2003 as a charge off date. Now I am aware why I can't get any credit. This has literally destroyed my credit score.

I spoke to the clerk at federal bankruptcy court. The judge was given copies of my transunion credit report more then likely i was told today that gmac will be found in contempt of court being that gmac is in violation of the us bankruptcy code.

I have written a letter also to the attorney general of the state of CT Richard Blumenthal asking him to put a stop to this under handed credit reporting. This account should have not been reported like this.

I am going after gmac legally as well. Tomorrow I am going with my attorney and I am filing a lawsuit against gmac for defamation, willful injury and violating the fcra section 623, as well as numerous other charges like unauthorized credit inquries after bankruptcy.

If they, gmac, reported this right from the start this would never had happen. Even trasunion agrees with me but they only report what gmac reports to them. Once I get a case #tomorrow and a process server to serve gmac I will keep you posted. I also sent a letter to the editors of the new haven register and the ct post in bridgeport they express interest in my story. Hope it will be picked up on one of the nations wire services as well.

It would stand to reason a lease is different

I am not a lawyer, but I do work with leases. It would stand to reason that a lease would be handled differently under bankruptcy... The "lease" obligation would be discharged, but what about the fixed purchase price? If you didn't return the car, they may be able to come after you for the fixed purchase price of the vehicle. The "lease" obligation and the "end of lease" obligations are two completely different things. I would suggest asking the lawyer about that. GOOD LUCK!
