I have become quite beside myself with this organization for a number of reasons. First off, the family has been traveling to los cabos for the past 30 years, in fact it is the only vacation spot we travel to in Mexico. We came across GM los cabos during one of our stays and decided to add another Cabos week of timeshare.
We became disillusioned early on when we could not get reserved in the size of unit or the week we wanted, to be able to spend 2 consecutive weeks in los cabos. After "fighting" we finally got a reservation. During our stay we went on the presentation to hear about the new Grand Luxxe los cabos that was to be completed in 2 years. This was very important for us since los cabos is the only destination we travel to in Mexico. Salesteam showed us a beautiful suite and model of the Grand LUxxe and said it will be finished in two years which would be summer 2011.
A major point we asked about various times was when construction would be completed in which the manager assured that it would be by 2011. They said it will have 2 golf courses and be built on a bluff. They also showed us how profitable it would be to rent out the GLuxxe units to upscale travelers wanting to visit los cabos so we decided to upgrade from 2 Weeks GM to 4 Weeks GL and paid an addl 80k on top of the money we already invested.
When nothing was happening with the rental of my weeks I called the organization and somebody proceeded to inform me that the organization actually does not rent weeks and that a list of companies was given to me of who does rent weeks, which made me very confused since I was under a different understanding. I knew then that something was not right. I remembered I was told by the salesrep to initial a clause in my contract that clearly contradicted the rental presentation given to me by the salesrep and manager, a clause that says that the company makes NO representations regarding the market for vacation ownership rental, but during the WHOLE presentation the salesrep and manager spent a lot of time talking and showing...REPRESENTING the amounts that could be made by renting the weeks out to other people.
Classic bait and switch I now understand! The salesrep said the organization needed to market weeks to others for marketing purposes. In fact the sheet of companies to rent wks was given to me which after re-reading I noticed the actual wording said that I REQUESTED the document, which is nothing further from the truth since the document came with the rest of the paperwork. The rep said while signing the docs that the companies on the list would be used if I wanted to rent weeks out on my own, which was never something that we spoke about. That is when I began to feel that an active, organized attempt was being made to cover the tracks, so to speak.
The last straw is the MAJOR fact that the Grand luxxe los cabos has not even started construction yet and after hearing from a friend of mine who recently visitited one of the properties and went on a presentation, the salesteam is just making more excuses for lack of construction. One reason was due to building elsewhere and bringing some entertainment companies that that was the major focus. That to me says GLuxxe los cabos is not the focus and that my addl 80k has been or is being used to build another resort that my family does not travel to. We were sold that our money would be used to build los cabos gluxxe.
I am suprised that I am the only one voicing my concerns with how GLuxxe los cabos is charging a lot of money for a product that was supposed to be delivered in 2011 and we are now finishing 2013. I and others have been waiting now for FOUR YEARS for the company to deliver and it does not appear that they will deliver by 2014 either since they have not even started construction yet. How can they have a model and tell you they will build something that has not even began construction? Buyer Beware ...BTW I wonder who the big entertainment companies are that have partnered up with this organization? Are they aware of the amount of unhappy clients?

I've spent a lot of money and i was scammed by other companies trying to cancel my timeshare. My advice is that if you're going to hire a company to help you with the problem, DO NOT PAY ANYTHING UPFRONT, because it use to be a fraud. Update: Lawyer contacted Profeco in Mexico this morning to ask about Consumer Law and Pre Construction sales presentations. The exact question was how long does Mexican Law give the Provider to deliver on a construction promise. The answer was that the law does not give an exact time but the law does take into account a "reasonable" amount of time to deliver, in which FOUR YEARS does qualify to open a case.
I have also discovered that other locations of this organization are presenting GLuxxe for sale too but only two properties actually have suites available which means other clients are in the same seat as we are.
Our lawyer also was informed today by PROFECO that all contracts should be in Spanish and English and that the Spanish Version is what is deemed legal and not the English Version. I/we have never received a Spanish/English contract version on the two times we entered into contract with them. Our lawyer is currently trying to retrieve the Spanish Version that should be filed with the authorities.
