Our mortgage was sold to these scum bags from B.O.A.

I have been dealing with them to have our taxes paid since March 2012.

I received a letter from an attorney on May 6th threatening a lien. I called Green Tree and they said that they will take care of it. I called the attorney's office on June 1st and was told that the bill has not been paid. I contacted G.T. again and was told that they paid it on May 16th. I contacted the tax office and spoke with a lady named Terri, who has been very helpful. She informed me that G.T. is the worse company to deal with when it comes to paying homeowner's taxes. Terri has also agreed NOT to place the lien on my property and encouraged me to call G.T. every week until it is paid and keep her in the loop.

I decided to take a different approach. Why should I keep calling them every week to be lied to? I've contacted a company (whose name I can not disclose at this time, because it may jeapordize my case) to assist me in this matter, but once my situation is resolved, I promise to disclose the information.

I can assure you that once this company contacts G.T., I'll never have any problems with them again!

I would like to know the name of the company that you are having contact Greentree. They have made my life miserable since I received this home in 1994.  I have a claims for roof damage, they have the check, I still have roof damage.  Someone should make them do the right thing. If you are one day late with your payment, they are on the phone calling you,,,,if they owe you, no one answers the phone and no one returns your calls.

Allonges Legal?

Thanks for the additional info. The GT Attorneys are still waiting, and waiting, and waiting... to receive documents from GT to file in court. The real question is: Does GT check the allonges? From what I can see, their purported multiple allonges, including the one to the trustee, US Bank, are not dated and will not hold up in court. As for me, US Bank, the purported Trustee, has No Standing and will not win. An un-dated allonge is the same as no allonge at all. No Allonge, No Standing. Simple. So many cases, so many wins....

"Before initiating any foreclosure on a mortgage loan , a Green Tree Foreclosure Specialist reviews the account being considered for foreclosure and confirms the following (i) the existence of a default that has not been cured; (ii) compliance with applicable legal requirements, such as pre-foreclosure defaul notices , counseling offers and mediation requirements;and (iii) that all reasonable efforts to cure the default or available loss-mitigation efforts , including Hamp or other modifications have been exhausted. "

Green Tree Attorney's Still Waiting

Green Tree's Attorney's are still waiting for documentation from Green Tree before they can file foreclosure.  I still believe we will win. Told Fisher Law Group maybe they would have better luck getting answers and documents from them then I. Green Tree can not even get their documents together to get to their own attorneys.

They are abusive Credit Card Collectors who have been trying to pose as a Mortgage Servicer for the past couple of years. A HUGE FAIL!

Their brains are not up to the task. It all starts from the top. They are brain dead for sure.

Keep digging. Knowledge is power. You never know what you will find. My continuing saga:
 
For example, another Lender (from the note serviced by Green Tree) is with Atlantic Coast Associates, LLC (ACA) in Maryland. Come to find out, ACA did not have a license when they issued my Deed of Trust in 2007 on my former primary residence. A non-entity can not enter into a contract (void). This loan ballooned after 3 years, and I renegotiated a new contract with them (not knowing they did not have a valid license on the first loan.)

Researched Maryland's system for anyone and everyone involved in this fraud. I was robo-signed on twice (by National City/PNC and GMAC.)

Research discovered that one of the ACA partners was also a a National City Bank (NCB) Branch Manager at the time I purchased my home in 2007 and took out the 1st and 2nd Loan from NCB. Conflict of Interest hardly describes this unethical behavior, and I had no idea.

NCB has already filed legal action against the ACA partner (who was also the NCB Branch Manager) for employment contract breach (doing his own side gig while purporting to conduct NCB business. It also appears that ACA charged their business expenses for things like my Credit Reports reports to NCB.

Talk about predatory lending. I kept asking the Broker (an ACA partner) why the loan for my primary residence was broken up into 3 loans (each with progressively higher interest rates) instead of the traditional 1 loan scenario. My broker (who was the other ACA partner and not disclosed to me) that this is how mortgage loans are now made. I could not get a great answer, but since I had used NCB and the Broker many times before, I "Assumed" all was fine. We all know what happens when you assume.

Now I keep kicking myself for being so naive (interpreted as stupid) to fall for 3 loans when i had an 802 credit rating. My first loan was a 30 year, 6.5% fixed which is all I wanted from the beginning. I was told it could not be done. Now I really wonder if that was another lie for the broker to have self enrichment and more commissions. The Greedy B*tch.

So the rest of the story: Also while researching ACA, I discover they voluntarily dissolved the LLC in March 2011. Just like Maryland's Attorney General's Office asked: If the LLC is dissolved, who is cashing your monthly checks? An outstanding question.

My mother also has a loan with dissolved ACA, LLC on her commercial property. Who is cashing her checks? If it were not for my research, we would have continued to pay these mortgages to a non-existent LLC forever. All I can say is "do the research."  The more I look, the more I find, the uglier it gets.

These people are all thieves and deserve to go to jail! May the force be with each of you and remember: do everything in writing to the RESPA address and stop the phone calls.

i have big problems to with this company im here to tell you the department of regulatory is a joke here in TN. they do nothing to govern this company i have done alot of reserch on my loan hey guess what they dont own my note and it all went through MERS robo sighners and all. people look out check your loans and deeds.

Green Tree basically laughed at my Good Faith attempts to negotiate a "right-sized" loan to value. Right now, I have almost $200k cash invested into my primary residence which is now worth $450k (and steadily declining) of which I paid $750k in 2007, and I am now $280k underwater (but even more if I tried to sell, etc. because of all the fees involved).

Green Tree did not believe me when I told them I would stop making payments and take them to court. I make $140k, have top secret clearance, and have a concealed license permit. Guess they thought I would not jeapordize that. Oh, how wrong my point of contact was. I do not make threats. I take action!

Every month was like the movie "Ground Hog Day." I kept reliving all the possible scenarios of a law suit and winning. Was i smart enough, did I know enough, would we be likely to win, etc. until one recent month when I knew the time was finally right.

Just wait, because I will post the depositions of Green Tree's employees on the Internet after we get to discovery.  I am readying to retire in a few weeks and will make this my mission in life. Discovery will take on a whole new life by the time this Type A, ESTJ with multiple degrees and certifications is done with them. That is the Point: I am so very done with them. Lucky thing I opted to become a CPA (and dated a judge for 6 years). Oh yea......

Taxpayers, investors, and Govt. pay for everything except: The Debt Collector must pay to go to court (while they are paying my monthly mortgage to the investors.) Now, they play my game by my rules!

All I originally wanted was a fair shake, but after the abuse I have suffered (including taking off a month from work for mental illness and treatment after they cracked my mind with the lies and lack of ethics). I am now all in and going for the nuts!

Debt collectors want to hold a credit rating over you like weapon of mass destruction. Let them play their games. That credit rating will be less important as time goes on. They know it. That is why the banks had the Credit Bureaus change their programs to ready them for all the renters who used to own their homes. Its another hidden conspiracy.

It also appears Green Tree may be committing fraud via creative accounting, with the assistance of the Credit Bureaus, by not reporting delinquent loans after 90 days. My loan status with Experian moved from "90 days" delinquent to "Current" after Green Tree sent my loan to foreclosure processing. Or, did they sell my loan, so it would be current to them? It may not be fraud, but someone is trying to make statistics look way better then reality.

The person at Experian, the Credit Reporting Bureau, who explained how my account moved to "Current" by Green Tree, LLC after they move it to foreclosure processing sounded awfully timid as I kept badgering he and his supervisor for an explanation. So, as the loan becomes more delinquent it is reported as current. This seems on the surface to be nothing short of FRAUD!

When you are so underwater, they think they have you by the nuts and can treat you any kind of way because you are trying to "Save" your home. Truth is, Debt Collectors want you to bail on them so they can collect the Default Insurance.

All I can say to Green Tree is "No Soup for You!"  See your customers in court!

The reality is that anything is the law (by default) in foreclosure until the owner shows up to object to everything and present Motions to Dismiss. Of course, that is after Maryland Mediation. Let them (or their customers) be the Plantiff and try prove their case. I will bust them because there is so very much more to this story.

You can take the girl out of the country, but you can not take the country out of the girl, and this country girl loves to fight (for justice and the rights of others). Bring it on!

As I said in my rebuttal prior to your rebuttal, I am no longer with Greeen Tree. However, I always paid my mortgage on time to them regardless of how terrible they were, because I did not want to ruin my credit. By paying my mortgage on time , I was able to refinance and get a lower rate @ 3% versus the 6% I had with Green Tree. I wish the best of luck to anyone who is dealing with Green Tree!

With Green Tree Servicing, LLC (and all other mortgage debt collectors), do not waste your time and energy making phone calls. All phone calls do is degrade your health, increase your anger, and keep you running very angrily in place. You will get absolutely no where.

My Green Tree Point of Contact told me to quit sending requests for information, because he did not want to deal with it. Poor baby. His desk was covered with all of my unanswered requests for information. As the story goes, I told him if they responded to any of my requests, I would not have to keep sending them.

So now, I send everything as a Qualified Written Request. They still do not respond, but that is on them to explain to the courts when I object. Motion to Dismiss (in multiples) will be coming at whoever decides to foresclose.

If you have a problem, keep sending it to them: 
1. In writing,
2. Via USPS Certified Mail (so you have signature receipt),
3. Only to the RESPA Qualified Written Address (no disappearing faxes, disappearing mail, lies over the phone.)

Leave an Audit Trail for yourself and others to follow.

Green Tree will blow anything through their lips, but never wants to respond in writing. This applies to all departments and all levels of employees.

The classic was a supervisor refusing to send the real reason my loan modification was denied: GMAC, my "investor", does not participate in the Federal HAMP, but the Denial Letter falsely claimed denial was based on bad credit. Wrong. My credit was great until I stopped paying my mortgages 4 months ago.

Turns out my "Investor", GMAC, only approved a one size fits all denial letter, so that is what Green Tree sent to me (and everyone else) while the supervisor refuses to correct their lie or send anything to me in writing.

Nail them to the wall with your evidence trail! It could not happen to a better group of people.

As I promised to you on June 29th. I can now reveal the company that I contacted. It was the Maryland State Attorney's Office who in turn submitted my complaint to the Maryland Commission on Financial Regulation who can better serve me with this problem. While this complaint was being addressed, my husband and I refinanced our home through our Federal Tower Credit Union! Green Tree can kiss us where the sun never shines! I encourage all of you who are under the thumb of Green Tree to get out fast! Good luck to you all.
