Huntington Bank repoed my vehicle and I hadn't missed any payments. I sued them and Huntington Bank was found guilty of "Conversion" and Breach of contract (see definition of terms below). My vehicle was sold at auction 1 month after they took it, so I never got it back and the lawsuit lasted over 2-Years.

Definition:

*Conversion n. a civil wrong (tort) in which one converts another's property to his/her own use, which is a fancy way of saying "steals." Reference: (link deleted - see below)

THE PROBLEM: is that Huntington National Bank left a Charge Off on my credit report after the trial showing I owed them money. Which the court said I didn't. Now, my report shows something much worse.

For nine months I wrote letters to the credit agencies and HNB to remove the false negative info and neither would remove the item even after I provided court documentation. The Credit reporting agencies stated it was HNB's responsibility to remove the item since they put it there and they also stated that HNB responded to their investigations by replying that I owed the debt and the item was not to be removed. HNB was ignoring the court order.

HNB repeatedly removed the negative item and would then put it back on my credit report. Dropping my credit score over 60 points in 9 months. On one occasion they removed the false negative info and left a phone number and name of a representative for future creditors to call for more details on my account.

If you cannot legally report certain information on an individuals credit record then you can't have people call in to get it. After I complained to the credit agencies about that, HNB removed that statement and phone number and again put the false negative balance back on my report.

I also found out that only one person is in charge of my HNB account. So, I don't beleive it's a case of the left hand not knowing what the right hand was doing.

Finally, after an appeal was heard and lost, HNB finally removed the false negative balance they reported on my Credit report. But, as I stated earlier my credit report is now worse than ever. HNB is now reporting "Account Status Charged off $19,XXX written off/past due." Payment history is listed not available.

Now the credit report looks like I never made a payment and they reposessed it. Seriously, what are they going to write, we stole it and sold it and the customer doesn't owe us? The court say's I owe them nothing, yet they still report this on my credit record and they still won't remove it.

I spoke with my current bank rep and he stated a charge-off is no different than a repo. I was turned down for a car loan and even though I have court documents to prove I owe Huntington nothing and my vehicle wasn't reposessed the lender didn't care. It's been 3-years since I owned a vehicle. If anyone knows what I can do about this let me know.

Please note. Most of the information provided here is matter of public record.

"Charge Off by definition"

Hello, In response to your other customer suggestion, I have some info that might explain this in more detail. It's a common misconception that "Charge-Off" means you don't owe the debt or it simply doesn't exist anymore. Not so. Here are actual definitions of "Charge-Off" and some tid bits from the Fair debt Collection and reporting law. A Charge-Off is a loan or credit card that is written off by a lender. It remains valid and subject to collection. Another definition: An item taken off inventory that cannot be recovered due to a skip, theft or damaged goods. The book value is deducted as an expense item. Basically, it is an Accounting term used to indicate that the creditor does not expect to collect the balance owed on an account and has removed it from their balance sheet as a loss because they don't expect to be able to collect. In this case the courts decided that no money is owed, therefore HNB cannot collect or report a debt that the courts ruled not owing, if the debt is not owed it's not valid which means it's not a charge-off. They can't report it. However, getting it removed is antoher matter. Plus, the fair credit reporting act say's they can't report false info on your report. As for the other consumer, your attorney should have contacted the collection agency and notified them of the pending lawsuits, the collection agencies would have held off reporting on your record until the outcome of the lawsuit. I'm sorry that happened to you and if you can still get a lawyer I hope it works out for you. By the way, flaming bags was funny. I would not recommend that though.

Charge Offs are the biggest loophole in the credit reporting industry.

I had some extensive medical bills that should have been covered by insurance, but the insurance company found some bizarre technicality to consider the expenses a result of "pre-existing conditions." While in the process of filing a lawsuit, the collector decided to Charge Off nearly $100,000 in medical bills. Why? Because they sensed a malpractice suit might be coming and that they probably would lose. The Charge Off was simply a way to take a vindictive shot at me....just as I suspect Huntington Bank did to you. I got about half of my losses back, but the Charge Offs have destroyed my credit-- at least for 7 years anyway. Since the term "Charge Off" doesn't directly imply any legal debt is demanded, the credit reporting agencies accept it as simply account information. It's a sick little conspiracy they have going with the credit industry. I hope I'm wrong, but I don't think anything can be done about it. The good news is, though, I live only a few miles from the Huntington Bank branch that did this to you and I'll be happy to drop off a few flaming bags of dog crap on their porch for you!
