It seems if one searches for previous stories, this is Jim Collin's shtick. He has taken our money as well and cancelled 3 times on coming to build for one reason or the other. He stops returning calls, then does and says the builders are going to be out there and then does not come. Sorry to say, we have probably lost our deposit too. However, I will be contacting the police about this. The Sherriff is a friend.

J.c.s Carports and Garages, Located in Deland, Florida Dispute this Rip off Report
Our Contracts state we do not return deposits if the customer can not full fill their end of the contract.
John and Wendy of Colorado, Springs did not complete their end of this contract. They (John and Wendy) could not get the permits they needed to let the Building Be installed on the Property.
J.C.s Did everything they could to help which always cost $ money. This Report is bad for J.C.s Carports and Garages as we try to be as honest as we possibly can with all our Customers. We have been selling Carports Buildings Sheds Barns and Garages for several years in the Deland, Florida area, and we have sold Buildings and Carports to the City Of Deland,
Florida as well
We know it is impossible to please everyone and we are hopeful that John and Wendy will forgive us.
This report needs to be removed from the web because it hindering our Business and in the economy today we do not need this distraction.
Out of all the Customers we have served this is the only report that has been filled.

On the date we placed the Ripoff Report we also faxed J.C.'s Carports and Garages a copy of the report. Within a few hours we received this response on their letter head. This is the response verbatim. - Mr. and Mrs. Kost, You were supposed to wait to pour your cement until you had your permit, you did not. You had problems with your permit due to cement and our plans wind exposure. Which I called the city of Colorado Springs and spoke to Rich Irwin, and to my knowledge it was all straightened out. A few weeks go by, and I get a call from Mr. or Mrs. Kost saying you built a different type of garage, which I still dont understand. Now, if you read your contract, it says there are no refunds on down payments. I have agreed to refund your deposit through the goodness of my secretarys heart. Because I dont feel like I should. This office put a lot of time and effort into this building. If you keep harassing us, I will not refund your down payment, and well see each other in court. Read your contract. Thanks -End of report- Well my husband and I are bewildered and quite disgusted by this response. The facts are not correct. The problems obtaining a permit were due to the fact that in El Paso county you MAY NOT have a metal building on a monolithic foundation. Also the wind exposure was incorrect and the architect seal on the plans was expired. Rich Irwin, the man at our building department told us he has NEVER spoken with anyone at J.C.'s Carports and Garages. Im sure that even if Mr. Sills or Mr. Collins did speak with our building department that would have done little good, as this is the law in our county, and cannot be changed by a simple request over the phone. However, the fact remains that Mr. Sills, or Mr. Collins gave his word he would call us back one way or the other to let us know the outcome of the call to the city. This never happened as you can see by the response from J.C.'s Carports and Garages. In fact they arent even sure if it was my husband or I that called back and spoke to him. We wasted weeks waiting for this company to respond, and found no other choice but to go another rout to get our garage built. We ordered trusses, made our own plans for a wooden structure, obtained a permit, THEN had our cement poured. I guess since Mr. Sills, or Mr. Collins dont understand we had no other choice but to go another rout seeing as they refused to return our calls. About our contract, well let me tell you about the professionalism of J.C.'s Carports and Garages contract and business practice. We were never informed of any such contract in any phone conversations we had with Kristin prier to sending our deposit check of $702.75. We were told that once they received our deposit they would finalize the specs of the garage, and then send us our PLANS. There was NEVER any mention of a contract or that our deposit was non refundable. When we finally received our plans, and the paper J.C.'s Carports and Garages calls a contract, in the space where our signature is required, it says mailed. Our deposit check was dated 4-7-2008, it was cashed on 4-11-2008, and the paperwork they are calling a contract was dated 4-10-2008 with an official change date of 5-5-2008. I also have the original envelope postmarked 05-05-2008. So, our deposit check was cashed 24 days before the plans, and what they call a contract was even mailed to us. Furthermore, Mr. Sills, or Mr. Collins gave their word three times to over the phone, and one time in righting to refund our deposit. We are quite put off by the second to last sentence in the response letter, If you keep harassing us, I will not refund your down payment, and well see each other in court. Is the company ever going to do what they say??? In one sentence they are going to send the money, then in another they are threatening to take US to court??? Are you kidding me??? So much for a mans good word. We have waited 10 days before updating this report to give this company plenty of time to make good on their promise. This once again has ended up with daily let downs at the mailbox. We have also contacted their local DeLand Delatona Beacon Newspaper. We also left a message with Mike Moltane at WNDB. We are responding to the Kost's accusations. There are always two sides to every story. The customer was supposed to wait to pour their cement until they received their permit, they did not. They called us saying they were having problems with the city due to the cement and our plans - wind exposure, so we called down to the city of Colorado Springs. According to the plans examiner for the city, everything was straightened out. After a few weeks go by, we get a call from the Kost's saying they built a different kind of garage and they wanted their money back. AS IT STATES IN OUR CONTRACT, DOWN PAYMENTS ARE NON REFUNDABLE. We have agreed to refund their deposit, but continue to be harassed by this customer. Seeing as it was our choice to refund the deposit, the more they harass us, the longer we will wait to return their money. We deal with many different states on engineering and many different cities and counties. Every city has different codes and regulations regarding accessory buildings. We do our best to keep up with them all. Some we have to handle as we go, after speaking with the city of Colorado Springs, we were told our plans were fine. Permits can take up a lot of time for our customers and for us, nothing seems to be done quickly with permits. Most of our customers understand this and are patient with the permit process...some are obviously not. We sincerly regret that this customer is so unhappy with us, we feel like we have done all we could, but they have gone with another company, there is not much else we can do. JC's
