Complaint: I sell children's clothes on the web for Magic Kids USA in Los Angeles. The way the process is suppose to work I send customers with my ID number to magickidsusa.com. I then receive a share of the net profit from what ever is sold to that customer. The problem is Magic Kids will not admit that I sent customers. I found out when I sold links to the site on ebay. The customers would pay for a link to the site and then Magic Kids would say that they did not even join the site. All the customers and the transactions should be listed but they are not. I also have copies of the web page with the wrong data. I have sent E-mails and called many times in a effort to resolve the matter. I am just ignored or given double talk.

I spoke with the Better Buisness Bureaus before I joined and they thought that the famous designer Isaac Mizrahi was Vice-president. He was not.I am not the only one that was fooled. Many of the scam disclosure sites on the web complain of problems with Magic kids.

We at Magic Kids have read and reviewed all the information pertaining to Elizabeth's claim(s). We have been very honest with Elizabeth from the very beginning. She has been promoting the website and we have paid her for every sale made from her referrals. In May of 2006, Elizabeth received her first sale. The merchandise amount was for $567.60, and her commission totaled $94.80. Her second order was a few months later in December of 2006. That order was for $43.23 and her commission was for $11.79. Since then she has received several orders and has been generating great commissions. To date Elizabeth has received $3993.19 worth in commissions paid, and she still has 1 order waiting to be paid from October 25, 2008. All orders received have a holding period of 30 days from when they are shipped in order for us to make sure that there are no partial / full refunds before we pay the dealer. When an exchange takes place, it postpones the payment to the dealer as well, since the customer is allowed 7 days to return the item(s) for an additional exchange or refund. In Elizabeth's letter, were several complaints and I would like to address each one it sequence. 1) She claimed that Magic Kids does not admit to the customers she referred to our site. Well, we have absolutely no room for admitting, our site is set up to list every new account created with her ID code, automatically. 2) Her second claim was that she sent customers via her link, and we said that they did not join. Its unheard of for anyone to sell links in order to view other sites, if they did arrive at our site and did not see what they were looking for, why would they join? She currently has a list of customers that did and didn't purchase. There is no explanation as to why the people she directed did not choose to register to our website. Either they were not interested or they may have returned at a later time and registered. So far out of her list of 23 prospects that she sent via her eBay link, 10 joined. Currently we accept orders from Canada, but not from all other countries, out of the 23 prospects, 7 were from Europe and Australia. Had they tried to register, the site would not have allowed them. As for the 10 customers she did have, 2 were from Canada and we do allow Canadian prospects to register and purchase from our website. 3) Her third claim was why all her customers and the transactions aren't listed. She has a valid claim. Over the past few months we have had many difficulties with our sites hosting company, which I will not mention their name. Due to the difficulties of moving to a dedicated server and support from our hosting company, our dealers have been unable to see some of the information they normally have access to. For this we take full responsibility and we have corrected this issue, and all dealers are able to view the commissions due to them. Also when a new order is generated, it will automatically show in the dealers list. 4) Her fourth claim was that we did not respond to her emails and calls. As per our records the last conversation with Elizabeth were in January 11, 2008, when she called in and had questions about a commission check she had received. We did not hear from her since. 5) Her fifth claim was that she thought that Isaac Mizrahi, VP of Magic Kids, was the same famous designer Isaac Mizrahi of Target. We cannot be held responsible for her mistake. We never claimed that they were the same person. She is falsely claiming that we fooled people into thinking that they were the same, when all along Isaac Mizrahi's picture is posted in 2 places of our website. 6) Her sixth claim, of scam disclosure sites complain of problems with our company. It doesn't take much for someone to post a complaint. Anyone can issue a complaint on a company and give others false impressions. We have stood by and paid Elizabeth for every commission due to her.
