I got a phone call at my job today from an "investigator" introducing himself as Matt Carlisle.  He proceeded to tell me about a payday loan that I supposedly owe that he has been investigating and if I wanted to do anything to settle it.  I proceeded to tell him that I had no outstanding loans with anyone and that if he had proof of anything I owed I had NO PROBLEM paying what I owe.  He replied that this payday company has sent letters to my address (where I no longer live) and they got no response (really? I don't live there) and that he reached out to my bank and has records that the money was deposited (never happened).  When I asked if he could give me some information he proceeds to tell me that he is going to reach out to my job and let them know that the marshalls are coming to pick me up for bank check fraud.  When I started quoting that I knew the law (Fair Credit Reporting Act REQUIRES a debtor to prove proof of debt via certified mail showing amount owed, when borrowed and the original debtor if the debt had been turned over to another office).  He then got irate and told me that I can just expect the marshall at my job because he's filing a warrant with Kings County court and that I can save my legal stuff for my day in court.  I'm SO over these people calling my job and if I could I would change my extension.  Someone has to stop this.

Excerpt from the Fair Debt Collections website:

Many people wonder if they can be arrested for not paying an advance payday loan. Although this is not a good situation in which to find himself, the good news is: no, can not be stopped in case of loan default payday. As a matter of fact, under the Fair Debt Collection Practices Act (FDCPA), it is illegal for any bank to threaten a borrower withpossibility of being arrested for nonpayment of debt. No matter how many received threats not to repay a loan, it can not happen since no law that allows them to be arrested for not paying payday loan to pay debt. As a result, you have no reason to worry about being arrested when you are in default on a payday loan or cash advance.
