In February of 2004, I was involved in a motor vehicle accident in which another driver INTENTIONALLY swerved his vehicle directly in front of mine and slammed on the brakes. I reported it to the CHP and to my insurance company, Mercury Insurance.

I filled out an accident report with the CHP and gave my statement to a representative of Mercury Unsurance. Shortly thereafter, I received a notice from Pamela Infantas of Mercury's claims department saying that they had determined that I was 100% at fault for the accident because I had rear-ended the other driver.

This was before they had even sent someone to inpsect the damage on my vehicle, and as far as I know before anyone had even contacted the other party involved in the accident.

Talk about adding insult to injury. I was already upset about the damage to my car, the disruption to my life - not to mention the fact that I could have been injured or killed by the criminal actions of another driver who intentionally tried to cause me to crash. Now Mercury Insurance was telling me that I was 1. a lousy driver 2. a bold-face liar, and, of course, that it would result in an increase in my insurance premium. None of these is acceptable.

Either Ms. Infantas is incompetent or this amounts to a deliberate attempt on the part of the insurance company to intimidate and humiliate its customer making a valid claim. I am sure there are probably many customers who would lie down and take it and just accept the insurance company's determination saying, "you can't fight the insurance companies". I will not take this lieing down. I will fight until a suitable determination is made and the other party is forced to pay and hopefully charged criminally and taken off of the road. The other driver is a road-raged maniac and is a threat to everyone on the road.

What happened to you sounds like a set up loss. It shows the signs of a "swoop and squat" loss. Second, you really should have discussed the letter you got with your adjuster. Here is why. Once you report your claim, the adjuster has to catagorize your loss into a pre-done list of loss types. Yours was propably just "insured vehicle rearended claimant vehicle." This causes the preliminary fault notification letter to be automatically generated by Mercury's claims system. While I disagree with the way the letter is written, if you read the letter, it is not a final determination of fault. As the letter states, it is a result of the "preliminary loss information presented." That being said, I still think it should go out after they adjuster speaks with the insured. Next, your claim should have gone to the Special Investigation Unit (SIU) for review and possible handling. For all I know, it may have and you either did not know it or they did not tell you. In either case, a proper investigation should take place based on what you reported. Make no mistake about it, Mercury's SIU is one of the best out there. Lastly, Armen sounds a bit over jelious. It seems like you need an active defense and some investigation done. Sometimes there is a big need for legal help, however I don't see this as one of them. What you need is simple good advice, which is something that everyone fails to do: COMMUNICATE WITH YOUR CLAIMS REPRESENTATIVE! They are human, and in most cases, over worked. Simply speak with them and tell them what you suspect and why you don't feel you were at fault. I, personally, would put it in writing and send it to the adjuster. Make sure you ask questions that require a response as the Unfair Claims Practice Act requires a company to respond within a certain amount of time if an answer appears to be warranted. Lastly, if the adjuster is not being helpful and/or dense, speak with their supervisor and try to communicate your concerns. Remember, you attract more flies with honey instead of vinager. By all means, you should not take this lying down. Call a spade a spade and accuse those whom you suspect of what you think they did. However, don't assume that your insurance company is not on your side; they probably are. Remember, if they find that it was a fraud attempt or done on purpose, it is in their best interest, too, to catch and prosecute the bad guys.

Oh Mercury is a rip-off My friend and i were hit by a drunk driver who also after doing so took off and left us for dead. Our SUV rolled and slammed into a brickwall knocking out 196 feet. The driver was promised that they would pay for towing and a rental car. Which they say are not going to do now. Also we were hurt very badly from knee surgery. head and neck injuries permanent damgage to my back and right shoulder needs surgery. And they have not paied us a penny or any of the medical bills. WE ARE DESPERATE HOPE SOMEONE CAN GUIDE US THROUGH
