I traded in a vehicle at this location. I got a Mercedes ML320. On the drive home, I realized that the gas gauge is defective, the engine warning light system came on, a strange whirring sound from the dash started.

I called the dealership as soon as I got home. No one would return my calls. Finally, two days later, I spoke with Pat Bender who told me they would make things right. He told me he would call the next morning.

Two days later, I am still waiting for his call. In addition, they charged me $2000.00 worth of FEES and charges at 29.90% interest.

CBS Atlanta Investigates: Doctored Car Reports

These are serious charges and accusations but it has been done before by unethical car salespeople. The above link for example is a to a CBS report that busted a dealership doing this which is resulting in law changes, and the salesperson was terminated. As well the dealership in question has now taken responsibility for those manipulated Carfax reports and they are offering to buy back any vehicles which were bought as a result of an altered report.

Now the laws may vary state to state regarding a dealership selling a vehicle that they knew had been in a substantial accident and withheld the info, or regarding whether a car fax report, altered or not can be admissible as evidence, but either way if this was the case it is fraud and should be stopped.

There is a chance however that the carfax report was not altered and does come up clean, but the other business used a different reporting agency which did have the updated info regarding the damages. If this is the case even if the dealer knew the vehicle was damaged, it would have to be proven that the dealer knew, and the carfax would then not be much good. Sometimes carfax does not have all the problems reported to them, or it was not properly updated which would hold neither the dealer, or carfax liable.

As far as the end of your report where you state they charged $2000.00 worth of fees at 29.90% interest, you have to be held responsible for that as well if you agreed to those terms and drove off. They would of needed a gun to my head before I would have signed to those terms. We are in a time of zero down zero % interest specials all over the place..but not for a Benz..something a little more practical that will actually hold some resale value and not cost a fortune to repair and maintain. And why you traded in a 14,500 dollar vehicle is beyond me, you should only trade in vehicles that are worth a couple grand at most..you must know all car dealerships will try to give you much much...MUCH less then KBB when you do a trade in..right? And in order to turn a profit, will tend to sell a vehicle at higher then KBB. So while it would seem to anyone with common sense that correct, this dealer made out..it is not a rip off in the sense that you as the customer could have refused those terms and drove off with your other vehicle and not traded it for the piece of crap worth much less.

However if it turns out the dealership did actually forge or alter a report to knowingly hide damage, this is potentially a criminal activity. I would hope this dealership responds to tell their side.

DO NOT DO BUSINESS WITH NEWPORT MOTORS, NOW KNOWN AS "XCITE MOTORS"

I tried to return the vehicle. They wouldn't take it. I took it to a franchise dealership to get rid of it. Once there, I found out that NEWPORT MOTORS/ AKA XCITE MOTORS knowingly sold a car to me with a FRAUDULENT CARFAX. The vehicle had been involved in a SEVERE ACCIDENT which was NOT on their copy of the Carfax.
These guys will LIE through their teeth. They will take advantage of you. They are NEVER available when you call them. They are the SHADIEST CROOKS. Please, please do NOT let this happen to you!!!!!!!!!

Pros: They are pros at DECEIT
Cons: They WILL con you!!!!

They took my KBB valued vehicle worth $14, 500.00 and gave me a PIECE OF CRAP valued at $6000.00 on KBB.  I lost thousands just getting rid of this DEFECTIVE vehicle.
