Donna Apisa is the owner of Oceanfront realty int inc, Based in Princeville, Kauai, Hawaii.
We approached Donna to be the rental Management agency for our property in Princeville.
Oceanfront charges a fee to manage the property. We were fine until we spoke to the tenants who said they were paying almost 25% more in rent than we agreed for Oceanfront to collect.
This was over a 4year period of which the total came close to 25,000 dollars.
When we confronted Donna she played stupid to the situation. Not only was her company skimming but shes been collecting rent for us and doing our management for all of our affairs while being a complete liar.
Not only does this discredit her company but what shes been doing is obviously illegal. how many other people are paying high rents only to find out that Oceanfront realty is adding there own fee on top of the percentage they already take from property owners.
we had to let our tenants live in our place for almost 2 years free.
Since there was no way to prove this embezalment we could not sue.
We did report this problem to the authourities.
What a total scam company.
This is a warning to property owners on Kauai, find a different managment company.

This makes no sense.
Your tenants would have signed a lease, that lease would have specified what they were supposed to pay every month. If they agreed to the total price, while it may not be what you wanted to charge they agreed to it and you owe them nothing. If they were there this entire 4 year period, they probably agreed to it every year.
If there lease showed the rent you wanted to charge, but they were paying this extra amount every month, then all you have to do is get a statement from your renters showing the extra that they paid and you could go after this company. Of course if the paperwork you signed says they can do this you would lose. Also, your renters may lose some credibility if they let this go on for 4 years without bringing it to your attention.
If there is no lease(unlikely) you have no proof of the rent you agreed to pay and no reason for you to give these renters anything for "free". If you happen to have something originaly in writing, because it was so long(4 years) it is likely that the new amount they were paying would override that original agreement. So again..you wouldn't owe the renters anything.
But then we get to the numbers...
Based on some basic math, 25K over 4 years is about $520/month. To get to this amount as 25% over the rent you agreed means you agreed to about $2100/month. But if you gave them 2 years of "free rent" to make up for this, you in effect gave them close to $50,000 in rent, or about double of this "extra" amount.
Just based on the numbers. Even if everything else you stated is 100% true and you are somehow legally responsible to pay them back, there is no justification to give them 2 years of free rent. So you either are leaving out some key information, or you have just gotten ripped off again...but this time by your tenants.
