I worked for Open Systems Technologies (OST) for over a year. I was a Technical Recruiter responsible for recruiting candidates in Financial Services for OST clients including Bank of America, Citi, AIG and many other prominent companies. I worked with several other co-workers that informed me that, upon leaving OST, they were never paid commissions or final paychecks. My brother also worked for this company and left a short period of time before I did. He has also told me that he never received his final paycheck.
I have inquired several times with both my old manager, Justin Abrash, and the back office staff responsible for these matters, Joe Bernetich in New York. Joe literally laughed at me through the email I sent him and told me "Yeah...I will jump all over that..." That was the only response I EVER received from him
I have tried many times to resolve this matter and even wrote a letter to the Owner Mark Fiato. Under State Texas law an employer is required to pay a person after leaving a job no later than the next regularly scheduled pay cycle, which OST has declined to do. They are in clear violation of the law on this matter and flaunt it in my face every time I bring it up.
Their attitude is they can do what they want and nobody can tell them otherwise! As a recruiter for OST I was also entitled to commissions for the candidates I placed with OST clients. I never received my last commission either!!
I have talked to several people that referred candidates to OST and were hired by OST's clients and was told that either they never received the referral fees of were only paid a portion of the fee that was agreed upon. I have included the email I received from OST about my paycheck, which obviously shows they have no intent of paying me!!!
For the record. I have been told that they pay internal employees in advance, which my paystub says otherwise. After I pointed this out to them they said that my pay stub is wrong and that internal employees are not on the same pay schedule as contractors, which is a lie because everyone, including consultants get paid on the same calender dates. After going through this with OST for MANY MONTHS I am finally tired and feed up! I want the money owed to me and know my rights.
Open Systems is in clear violation of the law and they have not tried to fix their negligence or care to even try to do the right thing. They have continued to string me along hoping I will go away! If you notice from the email below it's always the other persons fault!
From the email I got from OST concerning my paycheck:He is checking tomorrow but this is what he said w/out looking.. Yeah...I will jump all over that...
He is more then likely confused on the pay schedule...we internal employees do not get payed like the consultants, meaning a week late. The check you got on tuesday was for up to the friday before...people often times overlook that. They never remember that the first check paid them up to date... I will check on it tomorrow
