I purchased a used forklift from Otay Mesa Sales, the battery charger that came with it was the wrong battery charger. I didn't discover it was the wrong battery charger however until a couple of years after I purchased it because I had been using one of my own battery chargers and didn't need to use the one that Otay Mesa Sales had sold to me... I didn't think twice about checking the battery charger from Otay Mesa Sales at first because I believed they were the experts and gave me the correct battery charger all these years. I finally needed the charger from Otay Mesa which proved to be useless. When I called them to tell them they gave me the wrong battery charger, they were highly resistant to helping me because they believed too much time had passed since the original purchase. They were the experts, what did it matter that too much time had passed? They sold me the WRONG BATTERY CHARGER, it's as simple as that. They finally said they would try to find me the right battery charger unwillingly however. It's been over one year and a half now and they still have failed to deliver to me the correct battery charger! I have called them several times over the year and a half time frame and they keep coming up with excuses as to why they haven't found a battery charger. I always have to call them, they never call.

I had my secretary call Rick at Otay Mesa Sales and he was completely rude and arrogant to her, as if we had no right to be inquiring about the battery charger, we were truly annoying them, and he let us know with his arrogant attitude. We told them we would be contacting the Better Business Bureau and he did not care one bit, he said "Go ahead!" We would just like them replace the wrong battery charger with the right one to go with our forklift. It is disgusting the way we are being treated when they should have known better than to sell us the wrong charger and they should just accept the fact that they made a mistake and behave ethically, dignified, and stand behind the products they sell... UPDATE, we've emailed them and contacted the BBB and they still choose to ignore us weeks later

We contacted the BBB and Otay Mesa Sales replied by choosing to ignore the fact that they said they would replace the battery charger, insisting that their "ONE YEAR WARRANTY" had expired... here is our rebuttal letter to Otay Mesa Sales...

To Otay Mesa Sales, Inc

Plain and simple, I do know how to read, I understand warranties...You gave me the wrong charger purely by mistake or intentionally, it makes no difference, it was a mistake I called to your attention once I discovered it, and this was only because a professional electrician informed me... had I used the charger the first year, it would have had tremendous negative consequences on the life of the battery.

Plain and simple, right is right, and wrong is wrong, act like an ethical business with integrity and honor your word.

In essence, by refusing to exchange the battery charger and hiding behind your "ONE YEAR WARRANTY CLAIM," you are sending this message to your customers - "HA HA, TOO BAD YOU TRUSTED OUR SUPPOSED EXPERTISE, TIME IS UP, YOU LOSE, WE WIN ... TAKE YOUR PROBLEM AND SHOVE IT!"

I am disgusted that you've chosen to behave reprehensibly regarding fair business practices, your actions are inexcusable especially since you are supposed to represent an A+ business ethic... Respectfully, (Name of Company not disclosed)"

We were advised by a lawyer who said this..."I think that the Otay Mesa Sales knew they could lie to you because when you first contacted them they seemed as if they might help you out with this matter -- then they strung you along for 2 years knowing full well that the clock was ticking on any claim you might have -- and now when the statutes of limitations has run out on you, they are telling you that there is nothing they can do, because they are fairly confident that if you pursue it into court they could get it dismissed by stating that the statute of limitations has run out.

So there you have it, Otay Mesa Sales Inc, plain and simple are liars who have no qualms about ripping you off.
