I have purchased iPods from Peter in the past, but this time he has completely lost my trust in him and his business practices. His Web site says "All of our products are brand new. We keep our prices low by selling previously returned items that have been un-opened or un-used. ALL ITEMS SOLD COME WITH A VALID FULL MANUFACTURER'S WARRANTY!" Unfortunately, that's not true.

In early November 2005 I purchased two 20gb iPods from Peter through Open Box Prices. I received them and they were in sealed boxes. I shipped them out to my customers without opening them. Both customers wrote right away to say the iPods were heavily scratched and they were very unhappy with them.

After getting the iPods back from the customers and refunding one, I communicated with Peter frequently via e-mail. The iPods were both heavily scratched front and back. The most Peter has ever communicated to me was "minor scratches." The click wheels on both were not working. I tried to get service through Apple under their "full and valid warranty," but Apple told me that both warranties were expired.

I tried to get a proof of purchase from Peter to forward to Apple so I could get the iPods serviced or replaced. He refused to give me any receipt. He told me to make one up for any customers that asked.

Finally at the end of December, I thought we came to an agreement. I would ship the iPods to him and he would replace them and ship the replacements back to me. He would replace them either through Apple or himself. I shipped them to him Dec 31, 2005.

Well, finally the middle of February 2006 I filed a claim with PayPal as Peter continually refused to return the iPods to me or refund my money. As soon as I filed, he wrote to me and said I better retract the claim or I would never see the iPods or my money again.

I guess he decided against that line of action, because last week I got the two original iPods back from him. Still heavily scratched (of course) and still with no valid warranty.

When I contacted him and said that this was unacceptable, he said he cannot refund my money, the iPods are in perfect working condition, and that my claim was being closed out.

Well, that is not true and I am going to pursue this issue in the courts, if necessary, to obtain a refund of my money. I have definitely been ripped off!!

I hope that no one that reads this report will make the unfortunate mistake of doing business with Peter Leshaw or Open Box Prices. He also does business through Grafx Consulting, Inc.

Cory, I'm sorry that you misinterpreted my report. I did not sell them as new. I clearly state to my customers that they are open box items. But these particular ones were not sold to me as open box, but as new--as the Web site states. They came in shrink-wrapped packages and I am not going to sell a shrink-wrapped package and then open it before sending it the customer. I do not lie. It's not in my system. I am overly honest, as a matter of fact. Yes, I expect that when I receive a defective product that was sold to me as new and with full manufacturer's warranty, that it be just that. It is neither. I have been ripped off. If you can't see that, I ask you to re-read the report. Peter stating that he "can't refund my money" is a lie. He can. He just doesn't want to. He has sold me useless goods and spent the money, most likely.

You buy "returned" items, the hottest item on the planet and then sell them to your customers "as new". Why would they be returned? You don't open them to inspect them. Then, when they come back, you want the first guy or apple, to repair or replace them. Everyone's lying to everyone, all the way down the line. He's scamming you, you're scamming your customer. If you're in UT, good luck going after someone in FL, in court.
