On December 02 2006 I went with my girlfriend Marcella to Power Dodge on Bell Rd. to look for a car for her. She found a 2006 Chrysler Sebring convertible she liked, we negotiated a sale price of $14,981 with Brian the salesman.
Doug Moore the finance person started drawing up the paper work, in the paper work he included $99 for "permaplate", $115 for "theft protection" and $2590 for an extended warranty. She told Doug she did not want the extended warranty, Doug told her that was fine and that he'd just submit the paperwork to the finance company with it just in case she wanted it, but that she could remove it anytime she wanted to.
Marcella has some minor credit issues so she signed the paperwork at 14.1% interest and she would also be putting $1000 down at the time she picked up the car. Brian the salesman said that the car would ready for pickup on Wednesday 12-06-06 because it needed to be detailed and whatever.
Wednesday morning she received a call from Doug Moore that everything was fine and she could pick up the car that night, she explained to Doug that she wanted the extended warranty, permaplate and theft protection charges off the loan. He said it would be no problem and they would redo the paper work when we got there.
We arrived that night, talked to Brian for a few minutes and drove the car to make sure everything was OK with it. Doug was not there by this time so we were refered to Tony who said he was the finance manager. Marcella paid Tony the $1000 down payment and started discussing the contract and the conversation she had with Doug that the items mentioned earlier would be removed. Tony claimed he could not alter the contract because he did not write it and that we would have to come back the next night and deal with Doug.
Doug called Marcella Thursday morning and stated that the interest rate had increased to 16.99% and that she would need to sign new paperwork. Marcella stated again that she wanted the extended warranty, theft protection and permaplate charges removed and then she'd sign new paper work.
Doug called back a few hours later and claimed he got the interest rate back down to 14.1% and that she would not have to come back in and sign new paperwork. Marcella AGAIN stated she wanted those charges removed regardless of what the interest rate was.
A little later Doug called again and said he wouldn't be there when we got there but that he had talked to Tony about redoing the paperwork and we could come back that night and sign new paper work.
When we arrived Thursday night Tony immediately had an attitude with us and said that she had signed a contract and she was stuck with it and that they would not remove the charges or change anything with the loan. She explained her conversation with Doug and that that was the whole reason we went back down there. Tony basically said "F-OFF" and walked off leaving us standing there like idiots in the showroom floor.
We went outside and Marcella immediately left a voice mail message for bother Brian and Doug explaing what had just happened with Tony. No one bothered calling her back for over a week and when Doug did call her, he claimed that they never had received her $1000 down payment.
She called Doug back and explained that she had paid Tony the money Wednesday when we went to pick up the car. Doug said he would look into it and get back to her. A few days later he called back and said that Tony claimed she did not pay him and she must go down there and pay them right away, Marcella said "yes I did, Steve was right there when I paid him". She told them that if they wanted the car back she would return it as long as they returned her $1000.
So as of today 12-26-06, Marcella is still getting constant threatening phone calls about her down payment that Tony apparently pocketed(no wonder he wouldn't deal with us and wanted us out of there so fast the next night). In fact today Doug left her another message claiming that if she did not give them another $1000 that would have the car repossessed.
In summary, Power Dodge ultimately refused to remove the charges that they claimed they would numerous times. They attempted to pad her interest rate by almost 3% and now have stolen her down payment. We are determined to win this battle with this completely dishonest ripoff dealership, and any help would be appreciated.
We know that we are pretty much stuck with the extended warranty and the permaplate and theft protection crap because she stupidly signed the paperwork after believing Dougs lies, even though they made several promises to remove it, but we are absolutely NOT going to allow them to steal $1000 from her.
