Below is what happened to me when all i did is go to buy a car at Powers Williams KIA Imports in Edmond, Oklahoma.

On June 14th around 11:00am i went to Powers Williams KIA imports in Edmond, OK. to shop for a car. I originally spoke with Brent a sales person that works there. He had me fill out some paper work, ran a credit check while I looked at cars. I picked out a 2003 KIA RIO. I was then directed to another person that was obviously a manager. I am not sure of his name but i would recognize him if I saw him again.

He told me I Pre-Qualified for the car and then told me I could write them the down payment checks and they would hold them for 30 days and let me make the down payments in segments if I didn't have the full amount right away. I wrote them 2 checks, One for $150.00 dollars and one for $350.00 dollars, for a total of $ 500.00 dollars with the understanding they would not deposit the second check till July 15th. They cashed the first check for $150.00 on June 16th and the second check for $350.00 on July 15th.

I explained to him that I was about to change employers and he told me, Don't say anything to the finance company for at least 30 days or so and we won't put that down on the paper work because it might jeopardize the deal. I asked him if that was ok and he said yes. We signed the papers for it and I drove home. 10 days later on June 24th i got a call from Nathan a finance manager stating that they needed me to come back in that they needed to redo the paper work, that there was a mistake on it.

I returned to the dealer on 26th of June. I was waiting for Brent the sales person I dealt with before when another sales person came up to me and informed me that they would have to SWAP out cars on me because they could not get me financed for a new car but could get me financed for a used car . I looked at a 2001 Ford Focus and decided on that one.

They went over the paper work and told me I got Approval on it from the finance company. But they would need another $ 500.00 dollars down. So I wrote them a check for the 500.00 dollars and ask them if it was all right if they held it till the end of July till they deposited it. They said they would be able to do that no problem at all.

I signed the paper work and drove home. Again on June 26th I received another call from Nathan stating that he had GOOD NEWS that they were going to get my payments down and that I needed to stop in to sign one paper and that was it, and I would out of there in a few minutes. I stopped in on the 28th of June and signed the papers that took my payments down to $ 211.00 per month.

I asked him if this was the last time he was going to do this (Calling me up to resign paper work and change the terms of the contract) and he said that it was a Done Deal, we have you financed. I received paper work from my insurance company on July 18th stating that the Finance Company/Lienholder was Affiliated Financial 4651 Sheridan St. Suite#100 Hollywood, FL 33021.

I heard nothing from Powers Williams KIA Imports about a financing problem for a month. Not one phone call or any correspondence. On July 22nd I called and spoke with Nathan and explained to him if they could possibly hold the 3rd check I wrote for the additional down payment of $500.00 dollars and if I could stop by and write them 2 new checks, both for $250.00 dollars and if they could cash the first one on July 30th and the second one on August 15th to make a total of $1000.00 dollars down payment. He said sure we can do that; it would not be a problem at all.

I stopped in on July 22nd and gave Nathan the 2 new checks and asked him for the original $500.00 dollar check. He looked through a bunch of paper work and said he could not find it. I then asked him if he would tear it up when he did find it and he said he would. I also asked him about the referral fee and he said he would look into it and to get back with him tomorrow.

I called him the next day July 23rd 2003 about the referral fee from referring a friend there that bought a car. They originally told me if I referred a friend and they bought a car that they would give me $ 100.00 dollars for the referral fee. When I spoke to Nathan about the referral fee he told me they had it there and to come on up and get it. He mentioned nothing about a problem with the financing to me when I was there on July 22nd or on the 23rd when I spoke to him on the phone. I told him I would be up sometime on Thursday the 24th. I arrived at Powers Williams KIA on July 24th at approximately 2:50pm, on my lunch hour.

I asked the front desk receptionist if Nathan was in and she informed me he was out of the office at this time. She asked me to just wait a few minutes and someone else would help me. I waited in the showroom till approximately 3:18pm that is when a Powers Williams employee walked up to me and asked me, Where's the car? I pointed outside to my car and said, it's right there why? He then said to me I need the keys. I asked him why? He then said, I need the keys right now, were taking the car back I asked him why are you taking the car back? is there problem or something.

He then said to me , Just give me the d**n keys now I asked him What's going on here? that is when he said to me We couldn't get you financed and in a very threatening manner he got right up in my face and demanded the keys again. Saying, Just give me the god d**n keys now

I asked him why? Why they said nothing to me for over a month and cashed my down payment checks. Notified my insurance company of the finance lien holder. He would not give me an answer. He just said I want the god d**n f***ing keys right now I informed him I would not give him the keys, that there was something not right quite going on here and that I was going to call an attorney, and started to leave to showroom.

I was about half way or so to my car when I heard the one powers williams employee (Denny Williams) screaming Your NOT going to get in that god d**n car, give me those f***ing keys NOW I started to opened my car door and got it about 8' or so open when Denny Williams started to shoved and push me against the car. Pushing me against the door trying to pin me between the door and the car. I tried to open the door some more trying to get in the car in fear that this man was going to cause me sever harm. That is when he shoved the car door so hard slamming the car door on my right arm with great force.

I screamed in sever pain and he again pushed on the car door very hard trying to keep me from getting in the car slamming the car door on my arm again. At this point all I wanted to do is get out of there for fear of my life. I literally pushed as hard as I could on the door and jumped in my car and pulled the door shut, which the other Powers Williams employee was trying to pull open as I closed it. I finally got the car door closed and locked it. One of the salesmen kept trying the car door trying to get in as i started to pull out making a U-turn, i was moving about 5 miles per hour or so when the same salesmen ran around to the front of my car and jumped in front of it. He kept running to keep in front of my car as I was making the U-turn placing his hands on the left hand side of the fender and hood of my car. I tried to turn more to avoid him and he just kept running to keep in front of my car. I was shaken emotionally so bad, in sever pain and in great feared for my life i kept pulling away and finally got out of the parking lot.

Not long after that about 3:35pm or so i received a call on my cell phone from one of the sales people threatening me saying I was in big trouble for driving away and they were going to call the police and tell them I tried to intentially run over the salesman. He also said that it was a felony for trying to run over the salesman and I would go to jail for it if I did not bring the car back to them and give them the keys right now. He told me if I brought the car back and gave them the keys they would not call the police. I explained to him that the salesman jumped in front of my car as I was pulling away making a U-turn, only after they assaulted and injured me and I did NOT try and run him over. I was in fear for my life from them attacking and injuring me. He continued to threaten me; this is when i hung upon him.

I drove back to work and informed my employer that I would need to take the remainder of the day off; this was around 4:00pm. Around 4:10pm or a little after I received another call from a person stating he was the HR Manager from Powers Williams KIA Imports. He said that if I didn't bring the car back and give them the keys i would be in big trouble and that they would have me arrested. He also said that if I didn't bring the car back they would come and get it. He then told me that the phone call was being recorded, this was about a minute into the conversation he told me this. He then said he would meet me at my house at around 6:00pm and have the $1000.00 dollars down i gave them, plus the $100.00 dollar referral fee they owed me. I told him I would agree to it,

Then around 6:10pm or so I received another call from Powers Williams KIA Imports from a person I did not know and he would not give his name. He asked if Rachel was there and I said speaking. He then said that I better bring the car back and give them the keys now. I asked him if he received a call from my attorney and he said I didn't get a call from anyone. I said to him, he should have called you by now and right away he started screamed.You better NOT go home tonight because I am going to come there and yank that car out of there, even if your in it. he then hung up on me.

My arm is hurting so bad i can hardly lift it. I do not want to drive because I am in an extremely shaken up state and my arm is hurting too much. I called the Edmond Police Dept and gave them a phone report of what transpired. They informed me if i could not make it tonight that i could come in tomorrow so they could see the injury to my arm.

When giving the phone report to the officer (Officer Cain) Telling him how I was assaulted and injured and the man jumping in front of my car. He then asked me You didn't try and run him over I told him NO I didn't I was in fear for my life and well being and I was all ready pulling out when that man ran around the car and jumped in front of it and continued to move in front of my car when I was making a U-turn.

Now comes the real lie. Powers Williams KIA in fear i would sue them for what they did to me, called the edmond police department and told them i stole the car and tried to intenntially run over a salesman there. They just flat out lied to the police.!!!! Powers Williams has been sued before for this kind of behavior and illegal underhanded tactics.

Now i have to defend myself against these false changes. I had to hire a criminal attorney which is costing me ALOT of money i do not have. My criminal attorney told me that the changes will be dismissed, but i will have to go to a hearing first for this to happen. BTW the attorney is costing me over $ 10,000 dollars. My civil attorney has filed changes against Powers Williams KIA Imports but i won't see any justice for that for quite sometime.

So beware---------- DO NOT GOTO POWERS WILLIAMS KIA IMPORTS IN EDMODN, OKLAHOMA. You will get ripped off at the least and most likely worst by these scumbags.

Hi Rachael, you comments on a report of mine about this same dealership. Im glad to know you finally got that settled. When they confronted me, i was actually hoping they would hit me so I could sue them for alot of money. I now live in alabama and actually wore as a saleperson for a dealership here, only we know how to do our job and would never treat someone like the way we were treated there. See, when they took my car back after being unable to secure financing, they hadn't cashed my downpayment check, and i was just 1 day late etting to the bank to put a stop payment on it. That would have been really funny if they had been stuck with the damages to the vehicle after they way my wife and i were treated. I really just wanted to let you and other know that there are good and honest car dealerships out there, i just seems there are more dishonest ones cause they make the headlines.

and as long as the car dealerships contribute to their re-election funds, about zippo will happen. Why do you think big companies get all the "perks" and the little guy gets crapped on? If you have enough money to stuff in the elected officials pocket for re-election, he will obviously favor that industry. He/she will not forget where those donations came from, and what they need to do to keep them coming in. I'd like someone, anyone to prove me wrong, please. I have lost faith in our "free" election process. Especially when a judge can determine who wins the election. Why doesn't my vote count? Back to the original plot, find out how much money that dealerships are lining the elected officials campaign, and know which one not to vote for. Then you may be able to get something done about those autodealers that commit criminal acts. Just a suggestion.

I had a similar experience with City Mitsubishi in 2001. At the time I was in the process of trasfering to my next duty station in the military. At the time I was ONLY looking at different 4x4 trucks. I was NOT out to buy a vehicle when I visited this fraudelent dealership. I had to relocate over 3,000 miles from Jacksonville making it hard to go back to Florida to pursue a case against them. After transfer I went on deployment for 6 mos. Read about this dealership on this site and it will show it is risky to be a service member on a car lot. Needless to say I will not walk into a F&I office again. If a dealership wants my business I'll sign the required documents in the lobby or other area with multiple exits to avoid detainment again on a very busy day. If another dealership wants to pull the same tactics on me I will have a means to defend myself. It is obvious that car dealers have been using the above tactics for generations. I invite a dealer to attempt this again. Since I learned that justice in "purchased" I feel I would have to protect my own rights because the legal system leans in favor of the wealthier party. Rachel I wish you the best in your quest for justice. I hope you can take his shirt and everything he has worked for and take all of his money until he joins the poor. I posted what happened to me in regards to Powers Williams KIA Imports in Edmond, Oklahoma. Well i have great news about my case and all the lies Powers Williams KIA told the district attorneys office and the false changes that were files against me. On Jan 23'th i had my hearing to defend myself against the 2 false charges, 2 felony charges. Well i got to the hearing expecting to hear them lie their asses off but guess what, They never showed up.....yes that right, the witnesses never showed up. Wow what a surprise.....well not really.. I guess the witnesses got a case of conscious and decided lying was not worth it. So all charges were dropped and the case was dismissed. Now comes my civil law suit and my lawyer told me we are looking at 7 figures. So maybe some justice will come out of this. But what i would really like is to see the Powers Williams KIA employee that attacked me and injured me in jail where he belongs. OH, by the way.. that Powers Williams Employee was out on parole from a Texas Federal Penitentiary at the time he attacked me and living in a half-way house. One of the rebuttals that was written to my original post stated I am afraid to go to Car Dealers now.well guess what so am I..deathly afraid, in fear the same thing will happen to me again. When will the State and Federal government step in and stop this. Stop the Fraud the Lies, the scams and all the dishonest acts they are currently pulling on us honest citizens. It's evident out government will most like do nothing until us citizens stand up and say ENOUGH is ENOUGH..we will not take is kind of fraudulent treatment any more. So..write your senator and congressman and tell them you are feed up with this and want action NOW.

Due to circumstances I may be on the market for a car again. Because of a Mitsubishi dealership I'll be ready when salemen want to use any means to make a sale. If I don't like what I see I will walk out of the door. If a salesman wants to physically block me from leaving I hope the person feels its worth it because I will have the means to defend myself nextime. My last bad deal was not due to ignorance or lack of homework. It was due to gross deceptive and unfair practices. For all of you F&I managers and salesmen that use underhand tactics I'm amazed you can walk around and feel safe without looking over your shoulder. Sure you may get away with it in court because your victim did not have a way to record the incident. Do you think that you can defraud countless individuals without consequences? Actions of dishonest dealerships have destroyed countless families and lives. It is obvious that the government agencies that are supposed to regulate car dealerships are either overworked or do not care. Do you really think your victims will just forget what you did to them? You are playing the odds of the person you robbed that they will let it go after all legal options are expired. It would not surprise if dealerships would grab children from their mothers and put them in the trunk of the car they want to sell because they feel they can get away with it. It is so obvious that the legal system favors the wealthy like car dealership owners. I would like a dealership to try the above tactics because I will show no mercy to the merciless. It is sad that shopping for the 2nd most expensive purchase is so unpleasant because of the majority of the car dealerships are dishonest.

After reading this I don't think I could ever go into a dealer ship again. This was simuluar to what had happened to us in Jacksonville,Fl. When will the goverment do something about these kind of practices being used on the consumers of america.We all need to stand up and do something to get a law in place so that this will never happen again to any of us. You should read about city mitsubishi-orange park and the one on atlantic blvd. in Jacksonville Florida. I was told by the State attory of consumers affairs there was nothing we could do it happens alot. If this is true then we need to put a stop to it. I recently read an article in the jacksonville times on January 21st in the business section "sumpreme court to take a look at lawsuits in loan deals". This article is exactly what we endured at city mitsububishi-in orange park. This case is Koons Buick Pontiac GMC Inc. v. Nigh,03-377.He was awarded 24,000 and they had to pay his lawer fees. This sounds hopeful. I just want what right. and this kindof tactics to end!!

Read about City Mitsubishi on this site and you'll see why I will never visit a car dealership without a means to defend myself again. If you can get a concealed weapons permit apply for one. Considering how far some dealerships are willing to go to defraud consumers and assault them to have their way. It is a fact that car dealerships are the riskiest retail sales businesses to visit.
