I was recently denied credit and obtained a copy of my credit report from Trans Union, and discovered a Providian credit card being reported as over 120 days delinquent! I had no prior knowledge of this account.

As best I could gather, Providian had solicited me in July 2000 while I was seperated from my former wife. I did not sign a Providian application. We divorced in early Sept 2000. I had changed my address with the US Post Office, since my ex maintained the residence. I believe my ex signed my name to the app & added her name, to get herself a card. Providian has not yet been able to provide me a copy of this application. All statements were addressed to both my ex & I at my former address. All charges were incurred by my ex-wife, and she made payments on the account until last year. By then she had run the balance up over the credit limit.

I knew nothing of this account until I discovered it on my credit report, causing me serious financial harm. I believe this should be considered fraud perpetrated by my ex-wife, and removed from my credit report. Providian refuses, stating that because they have a copy of a payment sent by my ex-wife shortly after the account was opened, and since that check was from a joint checking account listing my name (my ex had told me the joint checking account had been closed), that this is considered "implied authority" that I had knowledge of this account. Providian refuses to help me. I have never been contacted by Providian, and now I've got Providian ruining my credit!

You need to contact Providian and demand a copy of the original contract. I suggest via USPS, certified mail, return receipt requested. If they refuse to provide you with a copy, call the District Attorney's office and advise them you believe your signature was forged and Providian is refusing to forward a copy of this agreement to you. I have never heard of your name being on a check used to pay a bill being considered *implied authority*. Keep copies of everything, including phone notes and forward them to the credit bureau.
