Towards the end of May 2006, I went online to find movers to relocate me from Sacramento, CA to Rio Rancho, New Mexico. I wanted the company to do the packing on the 22nd of June 2006 as I'm disabled and the packing was too difficult for me to do alone. The loading of my household goods and my vehicle was to be on the 23rd of June 2006.

I received an estimate on the 30th of May 2006 from R & S Relocation and Storage via e-mail. The estimate was for $3900.85 and broke down as follows: 2508.09 "all inclusive" based on 4500 lbs, $492.76 to pack my belongings which included all the packing materials and $900.00 to transport my vehicle.

Around this time i began speaking with Jason Michaels, my sales rep. He assured me my move would go smoothly and that I had nothing to worry about. I remember telling this man that I am disabled and just how important it was that this move go well.

On the 6th of June 2006, Jason Michaels emailed me their credit card auth form asking for $1060.08 as a deposit towards the household goods portion of the move. He (Jason) told me at that time that they (R&S) had me on their schedule to pack on the 22nd and to load-n-go on the 23rd.

I spoke with Jason Michaels on the 9th of June 2006 asking him for their street address so I could overnight my payment which I did for Saturday delivery at an additional cost to me of $41.18 The payment was in the form of a cashiers check. It was cashed on the 19th of June 2006 at a Bank of America branch.

* Although the original "total" was $3900.85, I sent an additional $399.15 for a total of $4300.00 I have moved many times and know there are always minor additional charges. I did not want to have to have any monies due at the destination which is why i sent the whole amount and then some.

On the 13th, I spoke with someone named Christina ~ from customer service I think ~ who confirmed I was on the schedule. I expressed concern that I wasn't able to reach Jason. She apparently spoke with Jason (via e-mail?) while she and I were on the phone. the message she relayed to me from him was for me to relax and not to worry.

During the many phone calls between Jason Michaels and myself, he constantly told me to relax, that everything would be fine. He was "on it". I had no reason to worry, that he had me scheduled with his best movers ~ this guy named Brett Chilton. I believed Mr. Chilton was an employee of R & S.

On the 15th, I received a contract via email which did not reflect the $4300.00 already paid. A corrected contract was e-mailed on the 16th which i signed and faxed back to Jason Michaels on the same day.

From the 16th of June through the 21st when he called me, I had been unable to reach Jason via email or phone. All my numerious calls went into this voice-mail loop from hell.I tried customer service as well as dispatch with the same dismal results.

The last conversation of any kind i had with Jason Michaels and or R & S Relocation and Storage was the evening of the 21st of June 2006 when Jason Michaels called my home to tell me he had a mover for my vehicle, but they (the car movers) needed a $250.00 deposit to reserve the spot and insisted i send the funds immediately.

I told Jason the $4300.00 I had already sent included the $900.00 for my vehicle and that he needed to resolve the deposit issue internally. I asked him to call me back with the time the car movers would be at my house to pick up the car. I've not heard from him since.

My cats had already been picked up by the pet travel people, I had airline reservations for that coming saturday (which i had to change at attitional cost), I had given notice on my apartment and was now stuck in Sacramento with no movers. I was able to contract with another moving company at an additional cost of $6500,00 however because the move was out of state, it would take some time to get my things to New Mexico.

I got in touch with a company called MoveRescue for some assistance. They sent to Daniel Bruce, the Owner of R & S Relocation and Storage, a letter demanding R & S return the funds they stole from me by the end of July. R & S did not respond to me nor did they refund my money.

The stress this caused was contributory to me being admitted into the hospital at 3:30am on July 5th and released on the 8th of July 2006. I incurred additional charges there as well.

I have been refered to an attorney in Texas and intend to pursue this matter until I get a resonable resolution.

Y'all might also want to look at a web site I came across that R & S has out there - FreeMovingLoads.com You have to see it to believe it.

This is an update to my previous post ( #208390 ) I have filed complaints with the BBB of Dallas, the FTA, the FMCSA, with the Attorney General of Texas and the TXDOT. The BBB was able to contact the owner of R&S Relocation and Storage because he did respond to the complaint. Mr. Daniel Bruce replied that no move was ever done (true), they provided an estimate (true) and claimed no monies were ever received (false). Even though i have the cancelled cashiers check clearly indicating "for deposit only Relocation and Storage" and an account number, the BBB would not pursue the matter because neither Mr. Bruce nor his company are members of the BBB.

Here it is 2 years later and I'm no closer to ending this nightmare. They still have my $4300.00 and I don't even know where to begin to get it back. Any one have any suggestions? Please ?!?!?
