I as others who have reported Rigby Industries and Jim Sedlacek on this site have been RIPPED Off.

I contacted Rigby sales early in Jan 09' where I first spoke with Mr. Sedlacek who was at the time very nice and quite willing to satisfy his customers, but this all soon changed. I placed and order with Jim and I was then contacted within 48 hours by Kim (She answers the phones) and does who know what else, and was asked to forward a deposit for the unit in the full purchase amount of $3,040.00, which I thought a bit odd for a company that was the size of what Mr. Sedlacek had lead me to believe they were. So they agreed to accept 50% up front and the remainder to be paid upon shipment so I sent them UPS next day $1,520 using their UPS account number they provided. They then cashed the check within 48 hours.

I was told by Jim that the unit takes about one week to assemble and I should expect to be able to receive it within 2 weeks from the original order date. Things changed real fast when I tried to find out where my order was after three week, which at this point I phoned them several times to inquire as to my order and I never actually got to speak with Jim because Kim (The phone lady) would say he was out traveling and making sales calls. She would always say that she would speak to him about the matter and either have him call me back, or she her self would call me right back, which neither ever happened. Now after we entered the 5th week I became even more concerned so I spoke with Kim who I will now call the (accomplices) and Kim stated that they were just now assembling the machine because they had been behind schedule due to weather and a large amount of orders. On week number six Kim said that our order was on the dock to be picked up by the freight carrier, which was another lie.

So without going into to much more detail I told her that if I don't get a firm ship date that day then I will need to cancel the order and ask for my deposit to be returned and this is when Mr. Sedlacek returned to the conversation and he was now very aggressive and basically attempted to blow me off and tell me what rights I do and don't have and I was not allowed to ask for a refund. Please read his response to my request to cancel both my order and our agreement for my company to represent his company here in Oklahoma.

Well we had to call you since we had not heard back from anyone and we were told that you were out traveling and could not be reached and nobody could give us a firm ship date and again offered to call us later that day, which did not happen.Now yesterday 2/9/09 Shana Khaler called to check on the progress of the previously stated ship date of 2/5/09, which we had been told by Kim on 2/3/09 and now we were informed that the machine was on the shipping dock and was set for pick-up by the freight company, but we found out that this was not true but Kim said she would call us back and tell us why it's not ready and when we can expect this item to ship, and again we did not receive a returned call. So I called today and spoke with Kim and she says that she knows nothing about when the order would be ready and again stated that she would contact you and have you call me at the number I provided her and this event never happened.The reason for the detailed references to the events that have transpired are to document the obvious misleading-leading statements that have been made by your company regarding our order and your total disregard for our original agreement, while you had already previously cashed our company check. I have made every attempt to resolve this problem and feel confident that it can not be satisfied to my company's and our customer's standards.Please consider this letter as our official notice of cancellation of the RS1 unit and all and, and or any other agreements our two companies have entered into. I will expect you to reply either via e-mail or fax in this matter within 24 hours of your receipt of this message. I will expect you to refund 100% of our amount paid to you or I will have no recourse other then to direct as if it was your desire to act in a manner of criminal intent by your company to defraud our company. To date 4/5/09' I've never received my machine, and in fact never got my deposit back either. I then employed the services of a collections firm who had contacted Rigby and were told they would receive payment for this matter, which Mr. Sedlacek would only agree to return $1,000 of the original $1,530 and go figure he broke that promise to them as well, and not ones but three times.

Jim Sedlacek of Rigby Industries is a thief, Liar, and SCAMMER who has been allowed to continue to operate under false representation of their abilities. Jim Sedlacek himself has committed fraud with the intent to steal money from distributor customers such as myself and cannot be trusted. Rgby Industries and Jim Sedlacek clearly represent their business and it's capability to meet their commitments to willfully defraud customers, which is illlegal!!!!!!!!

I would hope that others who read this message will not suffer from the lose of money such as I have, and will choose not to do business with Rigby Industries if they consider my situation.

It is unfortunate that a business such as Rigby Industries can continue to do business in a manner such as this, and until there are actions taken against them by either consumers such as us, and they are held accountable by the state of Ohio then shamefully there will be people and companies SCAMMING consumers. Please contact the Akron Better Business, and repot these actions to Akron's district attorney, state commisioners, and Attorney General.

SIX DIGIT LAWSUIT FILED AGAINST QUALITY SALES AND JACK PUCKETT PERSONALLY

Jack Puckett contacted Rigby to purchase one of our Scrap choppers in order to sell it to a customer of his. In order to get a less expensive price and recieve a commission on his sale, he asked to be a dealer for Rigby. A multi page contract was sent to him for his review. He signed it and sent it back to Rigby. He placed his order with us and sent in a downpayment. Rigby recieves a downpayment so that once materials are purchased on that custmors behalf, he can not back out and leave Rigby with the cost of the materials. This is a standard procedure for the recycling industry. Once he sent in his downpayment, He began to harrase myself and my office staff for delivery. He then contacted our competitor to sell their machine. He also began to demand his funds back. Since materials were purchased for his order, it was not our policy to return the downpayment. After a period of time, we agreed to send back his downpayment. The funds have been sent back to Jack Puckett, and Rigby ate the purchased materials. However, the harrsement has continued. It is Rigby's feeling that Jack Puckett signed a binding contract to represent Rigby, placed an order, and even sent in a downpayment to confirm the transaction. Rigby has had a great reputation in this Recycling Industry for many years. I am sorry that Jack Puckett was not happy and that he felt in these poor economic times ,we should of had a machine waiting for him.We feel we have gone above and beyond for Quality Sales. However, Jack Puckett has left us with no choice, but to file a 6 digit law suit against his company and one against him personally. Our claim, violating his contract with us and slander against Rigby and the company owner. All this for a machine that cost $ 3600.00.How stupid !
