I was temporarily working in Atlanta on a feature film, rented an apartment using Rochelle Brown's services and my deposity was withheld without any explanation. I soon found out through the Film Commission that there were at least 2 more people with similar experiences. The operation seems to be that she rents to people coming in and out of Atlanta, she won't return the deposit, and depends up on the victims to not legally pursue recovery because hiring an attorney and having to show up in court in Georgia make it too costly and inconvenient. Once you've left town and try to call her about your deposit, you'll be bounced around her different companies and employees until you give up. She comes up with inconsistent and made-up reasons as to why your deposit won't be returned to add to the inconvenience of proving her wrong.
Because her crimes are so blatent, the two other victims of her ruse and I contacted an Atlanta based attorney and we spent the money and time, about a year (which is what it incredibly takes), to have a court rule on each of our situations with our primary goal being to stop Rochelle Brown from ripping off more people by taking advantage of the legal system.
Our attorney, Chandra C. Davis, at McFadden Davis, The Employment Solution, put together a letter legally asking for our security deposits back with the specific laws as reference explaining why we're owed our deposity back. In Georgia, if a broker does not return your deposit within one month's time or list damages within three business days after the date of termination of occupancy, you are entitled to 3X damages:
Because you have not strictly adhered to the procedures for retaining security deposits laid out in Georgia Code O.C.G.A. §§ 44-7-30 through 44-7-36, you have forfeited any right you had to retain Mr. XXX, Mr. XXX and Mr. XXX deposit or to claim additional damages. Further, you may owe each respectively the sum of......plus attorney’s fees for each claim.
We filed our summons and complaint to Rochelle Brown and her companies in January and April of this year, and never heard. The court also never hear back. Therefore, we were just awarded a default judgment in which she owes us each triple damages. This is now on record with the Superior Court of Fulton County, State of Georgia. While Rochelle may respond with some wildy fictional account of how we three individuals were outliers who left our apartments "messy" or "ransacked," she did not make these claims to the court or legally in response to our request.
I know there are more victims out there who feel taken advantage of, and despite our early claims, Rochelle kept renting apartments as we heard of new victims even after we spread the word. Call our law firm if you'd like to pursue recovering your deposits, but don't let Rochelle Brown continue to get away with this.
