I purchased a bathroom vanity, faucets, and a toilet from S & H Bath, Inc., and paid a 60% deposit ($1250.00) when purchased. I was told that the toilet would be in within a week to ten days, and in approximately a weeks time I was told that the toilet was in. I tried to pick up the toilet on two, different occasions, however, I was told on both occasions that the toilet was not yet delivered to the store from their warehouse, citing several excuses. They then told me that they would deliver the toilet to my home address, and for a week they kept putting off the delivery, making numerous excuses. Finally, I was told that delivery would be coming on Feb. 15th, 2008 between 1 and 4 p.m., and was called at 3:30 p.m. and was told that they were running late, but would definitely be there for delivery. By 8p.m., they never arrived. I actually had a workman at my house since 2:30p.m. that day waiting to install the toilet, and had to pay for the workman's time.
I eventually learned the following tuesday that they never received the toilet into their warehouse, even though they repeatedly told me that the toilet was in. I then tld them I was extermely dissatisfied by their service and unthruthfulness, and wanted a refund of my deposit for all of the items purchased. I felt that I could no longer trust was they were saying, and demanded my money back. I was told that they would not provide me a refund, because the items were special order. This, however, was not true, as the faucets were in stock (as stated by the salesman, Norman), and the toilet was supposedly in the warehouse but was never delivered as promised, on several occasions. Futhermore, nowhere on the front of my sales receipt's does it say anything about no refunds for special order products.
However, on the back of the receipt, it does state a bunch of terms and conditions, in very light and small printing(hardly visible to the eye). At this date(2-23-08), they still have not refunded by money, and I am pursuing both criminal and civil action against this company. This company repeatedly told me that a product that I ordered and made a deposit for was in, and would be delivered on specific dates, but in actuality was never in, and was never delivered as promised. They eventually admitted that they made a mistake, and stated that the toilet wouldn't be in for two to three more weeks. Then, they told me that the toilet could be shipped from another location out of New York via U.P.S. within a week's time, and they would work out the U.P.S. charges with me.
Considering all the untruths that I was told regarding the original delivery, I would not accept this, and again demanded a refund of my deposit. Not only did they take my money($1250.00), but they cost me money(an additional $200.00) that I had to pay a workman that was waiting at my residence for delivery on the date delivery was promised. Finally, they actually had the nerve to state to me that they made a mistake about both the toilet being in and promised delivery, and that I was not being reasonable. This company repeatedly misrepresented themselves, and repeatedly told me untruths. I feel that I cannot do business with them.
