simon kaiwai signed a contract with me to sell showerbuddy my patented showerchairs he now calls the showerhelper and bathhelper. simon kaiwai and his wife susan kaiwai visted me in new zealand to learn about my unique designed showerchairs. simon kaiwai and his wife susan kaiwai wanted to sell my showerchairs in the usa because their was nothing else on the market like them.

we both went to china to research and find a company to make the chairs, i supplied simon kaiwai with detailed sets of plans to manufacture the chairs, after a dispute on how much royalty sisus corperation was going to pay me he went and got the chairs manufactured at a different company in china.

this was a very upsetting and bad mistake as the fda had a recall on his substandard chairs that reflected on me as a conscientious and careing designer whos first concerns are for peoples safty. simon kaiwai and his wife susan are very dishonest and untrustworthy people to deal with, they have no reguard for contracts or friendship and would sell their grandmother to make a dollar.

Lawsuit dropped for lack of basis

Danny Cancian initiated a lawsuit based on his beliefs which was dropped after we responded with the following information (see below).

Please be advised that Mr. Cancians allegations are
entirely without merit.  Mr. Cancian has
not been granted patents for his design, either in China (the location of our
manufacturer) or in the United
States (the distribution area).  The design for which he is currently seeking
a US
patent is faulty and unsafe, and furthermore, we believe that due to prior art,
his US
patent application is not likely to be approved.  We purchased ten units from Mr. Cancian in
October 2005, and after taking six months to fill the order, he refused to
honor his warranty when the chairs proved to be so poorly designed they
actually posed a serious safety risk to consumers.  We have attached an invoice for settlement of
the warranty claim.

Post identification of these design faults we attempted to
collaborate with Mr. Cancian to design a retractible shower chair that was fit
for purpose.  Unfortunately we were
unable to work together to accomplish this due to a series of bad faith actions
by Mr. Cancian and his associates.  This
included receiving CAD for a design that failed to redress safety issues
identified by Sisus.  Additionally the
CAD provided by Mr. Cancian included incompatible parts.  When we brought this to Mr. Cancians
attention he refused to assist with the requirement for a new design and costs
associated with the faulty molds for production.  It is at this point that our company was
forced to design a unique system and cease dealings with Mr. Cancian. 

Mr. Cancians actions are motivated by his ill will due to
our refusal to market and distribute his product, and our subsequent products which were substantially different.   His entire
claim is based on the fact that we once contemplated marketing his product.

Mr. Cancian is currently using a website design based on our
Companys, despite our request to his New Zealand attorney that he remove
the site.  Mr. Cancians refusal to stop
using our website design forced us to have our own website redesigned, at
considerable expense, to avoid creating confusion in the marketplace.  He has downloaded photographs of our product
from our website and is currently using those photographs on his website, advertising
our product as his own.  Evidence of such

and at www.showerchairs.net.nz.  We ask that these images be withdrawn
immediately.

FYI His company never made good on the money owed to us as per their warranty.
