My husband sold the car 1988 Mercedes 560 SL to the buyer Mike Lovullo 3.5 yaers ago on line on craigslict.com. First time  M. Lovullo asked to keep his stuff in our proporty for a while, we let him do that, then he went to police and said it was not correct number of odometer , but my husband showed to police his ad where was clearly state correct number.  Now M. Lovullo took a lawyer and start a case to fix his car.

Judge mr.J.W.Palmer jr. send  by mail ... his decision to pay  M. Lovullo $ 3,576.59 dollars. The lawyer didn't announce his decision in court how it's supposed to be. So people MUST to know about the decision , how honest it is??   Abviosly we ware shocked about that decision. Mr J.W. Palmer write down about a odometer???

My husband  didn't said nothing about  a mistake!! No mistakes in our site.  Odometer was correct. Why you trust them and not to us. Check before judging. Do not make a story in the cort sr.  Here Is mr. J.M. Palmer BIG mistake , Why here is a deception? In court? and we are file a reconsideration. And again denied.

That lawyer not knowledgeable enought about the case. He didn't listen and took info from nowear. Is it mean everybody who buy the car after 3.5 years have an apportunity to ask the money to fix the car??? Is this a really law here in NJ?? Really. Case OCN DC-012461-18

New Jersey State law states that sales of private vehicles is without warrenty and as-is. Why should we fix the car someone used.

Nobody should go to that court. I will stay there with the flag and tell everybody the way judge work here.

I don't know how many mistake that judge made during his job there. But I think not honest Mr.J.W.Palmer. He must be fired, in my view.

Do you understand this has nothing to do with a mistake on a Craig's list ad.  This has to do with someone rolling back the odometer on the car you used to own.

One of the things you don't indicate is whether you purchased the 1988 Mercedes as new.  However, let's assume you did.  Somewhere along the line, a mechanic that worked on your car rolled back your car's odometer for whatever reason.  With online car reports, it's sort of easy to figure out whether a car's odometer has been rolled back.

I suspect the car's online reports showed the mileage should have been higher. If you bought the car used from someone else, then it is possible you bought the car from someone who rolled the odometer back and you had no idea that had been done.  Unfortunately, the only recourse the buyer of your car has is to sue you because you were the one who sold him the car.

Since no one can prove your husband rolled the odometer back, it's probably why the judge didn't decide to reverse the sale and force you to refund the purchase price of the car ($15,000) because he could have.  Instead the judge is forcing you to make certain repairs to the odometer.

Selling a car without warranty and as-is, assumes the car is sold with the car exactly as the seller purports the car to be.  However, if the odometer is rolled back, then the car is being falsely advertised, so it isn't subject to as-is laws.  I'm afraid based on what you provided, it's more than likely you owe the money and the judge is correct.

However, what I am now going to say is important:  Please understand I am not saying you were being dishonest - not at all.  You are probably very honest people.  If you bought the car used, then it's likely the person you bought the car from - was very dishonest - and now you are paying for his dishonesty.

Best of luck to you...
