 I visited a this location with 2 co-workers yesterday and placed a deposit on a puppy.  I was ready to purchase the puppy, but was informed that the puppy had not received its vet check-up yet and could not be released to me.  I offered to purchase the puppy, provide a vet check-up tp them per their recommendation of Vet. And was informed this was not possible. I was told i could place a deposit on the puppy and pay the rest the next day. 

I placed a deposit "an amount that I chose" on the puppy. I had to request a copy of the receipt and the paperwork. As the associate, Paticia, was not going to volunteer a copy. She informed me that my puppy was not up on the site and my puppy would appear in a "gold" frame on the site as under deposit or purchased. 

The puppy was placed with other dogs in lieu of completion of its vet exam. This made me wonder about the location and contimination to other "cleared vet checked" puppies. I then proceeded to check read online about this business and do a web investigation. 

When I researched the site last night and learned of the numerous complaints against this location.  A lawsuit, name changes.  I also learned of clients that were shipped or picked up wrong dogs. And this most worried me.  My puppy was not listed on the site. And lastly and most concerning... I only observed 4 maltese puppies in the store for sale.  On their site, they have at least 19 posted! The same for other puppy categories. One can only assume that they are taking re-pictures of the same puppy and posting?

I called today, 14 hours later, to request my deposit be placed on back onto my credit card.   The puppy has still yet to receive a vet check. I stated I was concerned that they puppy has not yet been examed and this voided any agreement. I was informed by Patricia that my deposit could not be returned because it was against the store policy.  The Policy is NOT Posted in the store.    I was informed that it was on the information given to me that I requested.

Hello

You came into our boutique and left a deposit on a puppy and you were going to pick up the puppy in two weeks.   Company policy is that there are no refunds on dogs with deposits.  If you would like, as a courtesy to you, can use the deposit amount for supplies.  

Please understand that you signed an agreement and it's company policy and it will not be returned.   We are holding the puppy for you.  The health certificate is required to be given to you when you take the puppy with you.    I am not sure as to why you are saying witnesses, that does not matter.   You asked us to hold the puppy for two weeks so I am very confused.   If you are not ready for a puppy at this moment we can issue you a store credit.  This is the only option available.

MY RESPONSE:

A summary  per my conversation with Patricia at 2.15 cst this afternoon

  • I have 24 hours under business law to cancel a deposit. Per business law
  • Your part of the “said”  contract is not valid as the puppy has not had its vet examination. As well as not enforceable, as I cannot enter into an unknown agreement.
  • I have not purchased the dog, therefore for cannot deem the pet as healthy

I do not have anything that was given to me notifying me of your policy.

I was not informed of this verbally, it is not paperwork given to me at the time of deposit. And I cannot locate this statement on your website.

I had 2 co-workers with me at the time I placed the deposit. ......... and ...... Please provide paperwork with my signature informing me of my understanding of your deposit policy.

If you cannot provide today, I expect a full refund on back onto my card.

 I have a credit card receipt with nothing noted about this policy.  Patricia kept stating that due to the FLA PET lemon law the deposit is valid.  Yet, they puppy had not yet had its exam there for it voids any agreement in entirety. And I was not provided breeder information as indicated. Again. Voids it.   Unless you can be at this store, see a the vet report. Review the breeder information. And leave with the Puppy. I WOULD NOT PURCHASE FROM THIS LOCATION
