Just because someone had the bank write "cancellation" on the cashiers check doesn't prove anything except that the person asked them to write it on there.
According to the contract, "this contract is not subject to cancellation unless both parties herto have agreed to such cancellation in writing and such written cancellation is delivered to the Artist at leasat twenty-four (24) hours prior to the hour the performance is to begin."
There is no such agreement, because I never canceled the services. The only thing Mr. Benton can submit that will prove the event was canceled is a written cancellation agreement, signed by ME and HIM, and dated at least 24 hours prior to 7:30pm on 10/10/09.
Even so, that still wouldn't excuse the fact that it took SEVEN MONTHS to refund my deposit.

I just saw that in Monty's reply he states the wedding was 10/10/10, and that it was canceled. He couldn't be more wrong.
The wedding was 10/10/09 and it most definitely wasn't canceled. I'm attaching a copy of the contract that he generated.
If my wedding was supposed to be 10/10/10, why would the following email exchange exist?

Yes, SEVEN months after he didn't show up to my wedding, Monty finally refunded my deposit. It only took a couple dozen emails, a complaint to the BBB, a complaint to the TX Attorney General, a letter from my Attorney, and leaving reviews at this and several other sites to finally motivate him to return my deposit.

The canceled 10/10/10 wedding by our company of the Paul Anderson and the original deposit of $300.00 has been settled. We hand delivered a Cashiers Check(A copy is available) to his home. Here is the email correspondence:
