I began leasing a certain property in Laurens County, Georgia from Timberland Resource Services in 2007 for recreational and hunting purposes. At that time, and up until 2013, this company, and its owner Russ Falk, misrepresented the land (unknown to me) as being 100 acres in size.
In 2013 I learned from the local tax assessor, during his routine inspection/survey of the land, that it (the land) was actually much smaller in size (only 82 acres). *
* As it turned out, I paid $1400.00 more in per-acre lease fees than what I should have.
When I contact the owner (Russ Falk) of Timberland Resource Services, he denied the land was smaller than what I had been paying for and blamed the Laurens County Tax Assessors office as having incorrect records.
After months of me making repeated trips and calls from Miami, FL up to the offices in Dublin, GA to the Laurens County Tax Assessors office, the City Attorneys Office, and the Title/Deed Office, I was able to obtain all records proving the land was ONLY 82 acres.
Yet, the owner of Timberland Resource Services, Russ Falk, adamantly denied the land was smaller than what he collected money on for so many years and he even blamed the now-deceased owner, the Honorable Judge Dub Douglas, as misinforming him of the size of the land.
On September 24, 2013, in the presence of a witness in the office of Timberland Resource Services, I presented Russ Falk with the undisputable documentation PROVING the land I had been misinformed since 2007 as being 100 acres was, IN FACT, only 82 acres.
Russ Falk stated he did not have the $1400.00 to pay me back, but instead offered a 2-year lease agreement based on subtracting what was owned to me and me then paying the balance for the two year lease. Additionally, Russ Falk claimed the owner of the land, whom he represented, was fully aware of this 2-year lease in order to get me back the $1400.00 owned to me.
This 2-year lease was signed between Russ Falk and myself, and also signed by the witness, on September 24, 2013, and I presented Russ Falk with a US Postal Service Money Order in the amount of $807.00.*
* This $807.00 was the balance I needed to pay for the 2-year lease after the $1400.00 owed to me was subtracted from the balance of the upcoming 2 seasons (2013/2014 and 2014/2015 Seasons).
In March, 2014, an employee of Timberland Resource Services called me and asked if I was going to re-new the lease for the 2014/2015 Season. I informed the employee I had a 2-year lease on the land and that is was paid in FULL through May 2015.
Then, and again in March 2014, Russ Falk called me and said that the contract he had drawn up and we both signed and that was witnessed back on September 24, 2013, was incorrect and that I need to pay more money.
I made it very clear to Russ Falk I was not going to pay any more money and that we had a contract. Russ Falk was adamant and got angry – he told me if I did not pay more money than what was stipulated in the signed contract that he would “make sure I never was able to lease any land again”. (I hung the phone up on him.)
On March 24, 2014, Russ Falk called and informed me the land owners were coming out that day to see the land. He (Russ Falk) went on to ask me to “lie” to the landowners by saying I misunderstood the contract signed back on September 24, 2013, and in return he would see to it I could lease the land until 2017. I told Russ Falk “No” and he then threatened me (again) by saying if I did not do this he would make sure I never leased the land again, which I told him was fine with me as I had not intention to ever do business again with him as soon as I was able to get back the money he owed my through the current signed 2-year contract between the two of us.
On March 24, 2014, the landowners came out to the property and it was obvious they had no real idea of what had been going on regarding the size of their land being misrepresented to me by Russ Falk.
At the end of that conversation, Russ Falk stated I would finish the lease under the terms and conditions of the contract signed on September 25, 2013, and that in May 2015 when the lease was at its end, he and I would no longer have to deal with each other.
Then, on May 28, 2015, Russ Falk arrived at my hunting cabin’s front door while we were cleaning up to close things down for the summer and informed both me and a witness that he was having the land clear-cut (stripped of all pine trees). He went on to say this would be done immediately and that by the beginning of the 2014/2015 Deer Hunting Season there would be no more trees on the land except for the small wetland areas of hard woods.*
* This will ruin and destroy any and all decent hunting and recreational aspects of the land.
In closing:
1). I was warned I should be prepared and not surprised if Russ Falk did something to “kick me off” the land or to ruin my future hunting opportunities due to claims Russ Falk has a reputation of being both dishonest and vindictive.
2). It is my opinion, and that of others, Russ Falk intentionally defrauded me out of $1400.00 between the years of 2007 – 2013, and then proposed the before mentioned 2-year lease agreement with the intention of avoiding paying back the $1400.00.
3). I would have never agreed to the 2-year hunting lease, which was signed on September 24, 2013, if I knew Russ Falk would try to get out of the contract 6 months after we signed the contract. (Note: On September 21, 2013, I received an email message from Russ Falk specifically stating there was not intention to cut the timber on the land during the 2-year lease.)
4). According to Russ Falk the decision was made on March 24, 2014 to have the land clear-cut. This is the same date he and the owners met with me and all agreed the 2-year hunting lease would run through its completion date in March 2015 in order for me to get back the $1400.00 Russ Falk defrauded from me.
5). As of June 2, 104, Russ Falk and Timberland Resource Services continues to list hunting leases on its web site and not all are being presented for their actual acreage.
