CFPB Complaint November 2019

I wrote to Toyota Motor Credit on November 8, 2019 about my husband's accounts (7040056357571XXXX and 7040056245131XXXX) still being reported on his credit report unlawfully in hopes to get them removed.

Instead, I received the runaround from this company on November 18, 2019 through the CFPB website by claiming that they don't remove anything from the credit bureaus once they put them on there.  Furthermore, you are demanding payment for a time-barred debt.

Here are your exact words, "Because we are required to report your account accurately, we are not able to accommodate your request to remove the tradeline from your credit profile.  Please contact us at 800-826-9467 to make payment arrangements for the balance remaining on your account or for assistance with any other questions you may have."  All are lies, fraudulent and defamation of character.  How dare you!!!!

In fact, I have frequently disputed these two accounts through the credit bureaus with no success.  I have even see lawsuits come against Toyota Motor Credit for failing to remove such accounts from peoples credit reports.  This is fraudulent and illegal according to the FCRA.  I want these accounts removed immediately from all three credit bureaus or further action will be taken.  Thank you.

Only One of Two Removed

Only one has been removed from my husband's credit report and not both that I reported on previously. Toyota Motor Company is corrupt and acting fraudulently, and they know it. They are still violating FCRA too. I want the other account deleted immediately. Thank you.

Time Barred?

You used a very specific term, so what do you mean by that?

If you mean that the debt is beyond the Statute of Limitations, that is INDEPENDENT of the time a debt is allowed to be listed on a credit report.

A negative item can be reported on your credit report for 7 years from the date of the negative action, due to certain timelines this generally works out to be about 7 1/2 years. Even if the Legal Statute of Limitations expires before this, the debit will remain on your credit report.

As for requesting payment. A company can request payment on a delinquet debt forever. The only difference on a Time-Barred debt is that if they take you to court, you can use the Statute of Limitations to have the case dismissed.

Now with that said it appears your husband went delinquent around August of 2013 and ended up with a Deficency balance around December of 2013. This means that this item will remain on your husbands report until around the end of 2020, give or take a couple of months depending on the exact dates.

Perhaps your husband should have made his payments on time so that HE wouldn't have CAUSED the default! Oh yes, its all their fault, isn't it???
