We have been buying our home through Vanderbilt Mortgage for seven years.My husband is ill and we are on a fixed income.I spoke to a person at the Maryville office and told them to be sure to cash the checks I send them no later than the third of each month.[We have been on a fixed income since Januarry 2008.My husband became ill last year]I sent Vanderbilt a check on the thirtieth of October so they would get it while the funds were still in my account.I recieved a call from one of their reps last Friday who was not very nice.He threatened to foreclose if we didn't make the payment right away.Another woman called today and said that they are processing foreclosure papers and that we will have no choice but to move if we can't pay right away.I explained that I don't have the money,but,will pay on the first of Dec.She said ,NO,we will not wait any longer.My family will be homeless with nowhere to go.I didn't pay on this all this time to lose it.We don't know what to do.My husband is ill,I have recently had a mini stroke,we don't have the money and need some time.The people I spoke with are very uncaring and not courteous at all.They talk at me instead of to me and they don't give me time to explain anything.I feel that Vanderbilt is ripping families off by rushing to foreclose when families get into these situations.We were already one month behind because of my husbands illness,but,this time was not our fault.We simply can't afford to lose our home.I would also appreciate it if they would quit calling and threatening to take our home.Please help'I have enough problems without being harrassed because they are not willing to admit their mistake,but,they want to blame us.

Hi, I have several of my own postings with my experience with Vanderbilt....as to getting in front of a judge...that's what I did, been in front of them, since 2006...Vanderbilt and clayton, and Mr. Buffett are conspirators, to say the least, they are ripping people off left and right, with no documentation on loans, fraud and forgeries (in my case)....forclosed on myself, and I called their bluff, lost in local district, lost my appeals, however, probably the politics, in our fair NEw Mexico...I have filed banckruptcy to get my issues in front of a different venue...They will just send out their vicious, unproffessional law firm...I have filed complaints against them as well....cross your fingers, I do believe that there is power in numbers, I do not understand why there has not been any investigation at the federal level and I have done all those complaints as well, more than once. They are intimidating and have the ability to skirt the law, and judicial process, perhaps someone is feeding someone elses pockets, because so many people cannot be talking out their "horses assess"........I think however difficult though, the comment to "call their bluff" is a sound one, if your willing to go the whole nine yards...I am out a sht ton of money, and have not been able to retain counsel have been pro se all this time, i have lost my home, and all in all, I guess I have wanted to walk away many times, as the very thing I was fighting for is already been "handed" to Mr. Buffett, cuz I'm sure he want's my carboard box of a home, with mold, and bad roof, so he may use it as a vaction spot...and I will continue on.......for Rome wasnt' built in a day...lol So at the risk of not losing everyhting, which I already have...I am not laying down, I am and will not let them get away with this, So go for it, but only if your willing to compromise yourself, and be known as the local crazy person....and Mr. Buffett, my humble abode awaits your arrival, my five kids will be here to greet you as they find their bags and pack their pets in the truck to be homeless at your hands, and your attorneys, who have no regard for the judicial system, nor the lending laws!

File an answer to the foreclosure at the courthouse, call their bluff, who's to say you can't show up and tell the judge the situation and file a counter claim on them! Tell them to go for it, you Want to get them in front of the judge! Good luck

They attempt to cash/deposit the check and it is NOT honored because there is not enough funds in the account to cover the check. HOW is this their fault and not yours??? I'm sorry about the illnesses you and your husband suffer, but again, this is not their fault. Folks need to realise that ANY LOAN payment is required to be made or the loan goes into DEFAULT regardless of changes in employment/income status. I have mortgages on my some of my rental units BUT I have insurance that will pay off or continue payments should I die or become temporarily unable to earn an income. IMO if you require 2 incomes to make your mortgage payment and cannot afford mortgage or catestrophic insurance than you really couldn't afford to purchase the home.

Not sure exactly if one of your checks bounced or what. However, I work in the field and GENERALLY if you have not been behind alot before or if you have not been on a forebearance before then a mortgage company will not forclose on you until around the 5th or 6th month of late pays. This is a general statement now. That is not to say they won't drive ya nuts with calls. They will threaten all sorts of things and tell you they can not do anything, but forclousre generally happenes at the 6th month. Now if you have had a forbearance before this does not hold true. They will activate a forclosure when you fall behind again. So if you are on a work out plan( ie. forbearance) then that may be why they are saying this. If not they are blowing smoke. However, you will need to find a way to catch up because you will find yourself in a huge hole if you do not catch up. Mortgage companies do not accept partial payments. Good luck!

We got behind on our mortgage and were getting calls everyday. They were rude and would not try to work with us at all. So the only way we got them to stop bothering us was to file a chapter 13 bankruptcy. Our Lawyer finnally got them to stop calling us. Our payments that were behind are in our chapter 13. We have to keep our payments current now no matter what. So I suggest you talk to legal aid and try to get some help.

If you send payment on the 30th, how do you expect them to cash it before the 3rd? They probably don't even get it by the 3rd. October 30 was Thursday and the 3rd was Monday. That's not enough time. What mistake did they make? Did they cash your check after the 3rd and it bounced because you spent the money? If you sent them a payment on the 30th and it bounced because they didn't cash it by the 3rd, that is not their fault no matter how many times you tell them to cash it by the 3rd.
